HomeMy WebLinkAbout~Master - Amending Zoning Regulations ORDINANCE NO. 2972 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTION 29.20(26)(b) AND ENACTING A NEW SUBSECTION 29.20(26)(b) FOR THE PURPOSE OF PERMITTING ADMINISTRATIVE APPROVAL OF MINOR ALTERA- TIONS TO VESTED NON-CONFORMING MOBILE HOME PARKS IN R-5 ZONING DISTRICTS; ENACTING A NEW SUBSECTION 29.2(47) DEFINING CANOPY-FUEL PUMP; REPEALING SUBSECTIONS 29.22(2)(c) & (d) AND ENACTING NEW SUBSECTIONS 29.22(2)(c) & (d) FOR THE PURPOSE OF ESTABLISHING FRONT YARD AND SIDE YARD SETBACK REQUIREMENTS FOR FUEL PUMP CANOPIES IN G-C ZONING DISTRICTS; REPEALING SUBSECTIONS 29.25(2)(c) & (d) AND ENACTING NEW SUBSECTIONS 29.25(c) & (d) FOR THE PURPOSE OF ESTABLISHING FRONT AND SIDE YARD SET- BACK REQUIREMENTS FOR FUEL PUMP CANOPIES IN A G-I ZONING DISTRICT; REPEALING SECTION 29.30 REQUIRING LOT AVERAGING FOR FRONT YARD SETBACK REQUIREMENTS; RE- PEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE DATE BE IT ENACTED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code for the City of Ames, Iowa shall be and is hereby amended by repealing Subsection 29.20(26)(b) thereof and enacting a new Subsection 29.20(26)(b) as follows: "(b) (i) Existing mobile home parks may hereafter be expanded or enlarged, provided such expansion or enlargement in the new area is done in conformity with the provisions of this chapter and provided that the land area for the entire mobile home park, including both existing and expanded areas, is at least ten acres in size. Noncon- forming mobile homes used for residential purposes located on lots outside a mobile home park shall not be relocated, altered, or replaced except in compliance with the provisions of this chapter. (ii) Alterations or changes may be made within an existing vested non-conforming, mobile home park, located in the R-5 zoning district, provided that the number of mobile homes is not increased and provided that the size of any mobile home space is not decreased below the minimum required by this chapter. Minor alterations or changes may be approved administratively by the Director of Planning and Housing. Minor alterations or changes shall include: construction of or additions to storage buildings, community or recrea- tion facilities, maintenance buildings, accessory buildings or structures that are complementary to an individual mobile home, outdoor vehicle or boat storage areas, or other similar type uses. All construction shall meet the setback and spacing requirements as required by the R-5 zoning district. All other types of alterations or changes not specifically listed under minor alterations and changes will require the submittal of a plan amendment following the pro- cedure as established by the Zoning Ordinance. (iii) Minor alterations or changes shall be permitted only after a submittal of a site plan to the Department of Planning and Housing for review and processing. Such plan shall meet the submittal requirements and review standards as set out in Section 29.49 of this chapter unless waived by the Director of Planning and Housing. Within fifteen (15) days after submittal, the Director of Planning and Housing, in a written decision, stating findings of fact and conclusions pertaining to the stan- dards in Section 29.49, shall approve, approve with modification or deny the request. Upon approval or approval with modification, a building permit may be issued. Any person aggrieved by a decision to grant or deny a permit may appeal to the Zoning Board of Adjust- ment where upon said Board shall decide the matter. " Section Two. The Municipal Code for the City of Ames, Iowa shall be and is hereby amended by enacting a new Subsection 29.2(47) as follows: "(47) Canopy-fuel pump. A structure with a roof-like cover that is free-standing or projects from an automobile service station or convenience store with gas pumps for the protection of customers using the fuel pumps. Said canopy shall have a minimum clearance of fourteen (14) feet and a maximum height of eighteen (18) feet. No advertising shall be allowed on the canopy. The canopy shall employ an internal drainage system which shall discharge into the storm water drainage system. No discharge shall drain across any pedestrian walkway, parking area or driveway." Section Three. The Municipal Code for the City of Ames, Iowa shall be and is hereby amended by repealing Subsections 29.22(2)(c) and 29.22(2)(d) and enacting new subsections 29.22(2)(c) and 29.22(2)(d) as follows: "(c) Front yard: twenty (20) feet minimum setback. A fuel pump canopy may maintain a minimum front yard set- back of ten (10) feet. The setback shall be measured be- tween a vertical plane extending from the front edge of the canopy to the ground and the front property line. (d) Side yard: Five (5) feet setback with a minimum of fifteen (15) feet between structures on adjacent properties. A setback of twenty (20) feet if abutting a street or residential district. A fuel pump canopy may maintain a minimum side yard set- back of ten (10) feet if the side yard abuts a street. The setback shall be measured between a vertical plane extending from the side edge of the canopy to the ground and the side property line." Section Four. The Municipal Code for the City of Ames, Iowa shall be and is hereby amended by repealing Subsections 29.25(2)(c) and 29.25(2)(d) and enacting new subsections 29.25(2)(c) and 29.25(2)(d) as follows: (c) Front yard: ten (10) feet minimun setback, forty (40) feet if abutting an arterial street. A fuel pump canopy may maintain a minimum front yard set- back of ten (10) feet if abutting an arterial street. The setback shall be measured between a vertical plane extending from the front edge of the canopy to the ground and the front property line. (d) Side yard: twelve (12) feet minimum setback, forty (40) feet if abutting an arterial street. A fuel pump canopy may maintain a minimum side yard set- back of ten (10) feet. The setback shall be measured be- tween a vertical plane extending from the side edge of the canopy to the ground and the side property line." Section Five. The Municipal Code for the City of Ames, Iowa shall be and is hereby amended by repealing Sec. 29.30 regulating front yard varia- tions. Section Six. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section Seven.
