COUNCIL ACTION FORM
SUBJECT: Revisions to the Noise Ordinance
BACKGROUND:
On August 20,1985, the city staff asked the City Council to consider three
changes in the Noise Ordinance.
A. The option of taking the measurement reading from either the
complaininq party's property line, or the nearest street or
alley right of way closest to the source of the noise.
B. To lower the decibel limits for motor vehicles.
C. To eliminate the 50 ft. requirement and allow the noise measure-
ments to be taken from the same locations whether it is a party that
has received a permit to exceed or not.
The Council directed the University/Student/City Commission to review the
proposed changes and report their recommendations. The following conclusions were
reached by the committee:
A. The option to take a reading from the complaining party's property
should be permitted. Noise readings should be taken at the location
on the property where the complainant was disturbed.
B. Readings will be taken from the public right of way reasonably
appearing to be nearest to the source of the sound of an unidentified
complainant or officer on patrol .
C. The allowable DBA for motor vehicles measured from 25 ft. should
be 75
D. The noise readings should be taken from the same locations regardless
of whether or not a permit has been issued to exceed noise limits.
The staff has reviewed these recommendations and concur with items A. , C. , D.
Item B, however, goes beyond what the staff asked for and would make enforcement
of the ordinance more difficult. The police department believes that taking
the noise reading from the nearest street or alley way from the source, with th
option listed in Item A, would create the fairest and most consistent approach
to enforcement.
ALTERNATIVES:
1 . Take no action.
2. Pass on the first reading the attached revisions to the Noise Ordinance.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt alternative #2
and pass on first reading the attached revisions to the Noise Ordinance. The
changes would result in:
A. The sound should be measured at the edge of the city street or alley
right of way reasonably appearing to be nearest the source of the sound.
B. An option to take a reading from the complaining party's property at
the location on the property where the complainant was disturbed.
C. The allowable DBA for motor vehicles measured from 25 ft. should be
75 .
D. The noise reading should be taken from the location regardless whether
or not a permit has been issued to exceed noise limits.
These revisions would create the fairest and most consistent approach to the
enforcement of the Noise Ordinance. It is further recommended that the Universtiy/
Student/ City Committee and the city staff make additional efforts to ensure that
all members of the community are aware of these proposed changes.
