AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY
OF AMES, IOWA, BY REPEALING SECTION 23.22 AND ENACTING
A NEW SECTION 23.22 FOR THE PURPOSE OF REVISING THE
RIGHT OF WAY WIDTH; REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A
PENALTY; AND ESTABLISHING AN EFFECTIVE DATE
BE IT ENACTED, by the City Council for the City of Ames, Iowa:
Section One. The Municipal Code for the City of Ames, Iowa shall be
and is ereby amended by repealing Section 23.22 thereof and enacting a
new Section 23.22 as follows:
"Sec. 23.22
(2) Right of way widths. For all right of ways, the widths shall
not De less than the following minimum design standards:
Parkways, boulevards: One hundred (100) feet.
Arterials: Eighty (80) feet.
Collector, residential: Seventy (70) feet.
Business, industrial areas: Eighty (80) feet.
Minor, residential: Sixty (60) feet.
Cul-de-sac, residential: Sixty-five (65) feet with
fifty-five (55) foot radius.
Business alleys: Twenty-four (24) feet.
Residential alleys: Twenty (20) feet.
Upon request of the developer and upon concurrence of the
City Council, the right of way widths may be modified on
non-through, service access, minor streets such that
sufficient area is maintained for utility construction. The
minimum acceptable width shall be the proposed roadway width
plus 29 feet in residential-zoned areas and 35 feet in
commercial- and industrial-zoned areas. In no instance shall
the minimum right-of-way widths be less than 50 feet in
residential-zoned areas and 60 feet in commercial- and
industrial-zoned areas. "
Section Two. Violation of the provisions of this ordinance shall con-
stitute a misdemeanor punishable by a fine not to exceed $100.00 or by
imprisonment for a period not to exceed 30 days.
Section Three. All ordinances or parts of ordinances in conflict here-
with are ere y repealed to the extent of such conflict.
Section Four. This ordinance shall be in full force and effect from and
after its passage and publication as required by law.
