HomeMy WebLinkAboutA003 - Council Action Form, July 2, 1985 ITEM #: 7 DATE: 7/02/85 COUNCIL ACTION FORM SUBJECT: Request to Revise Section 23.22(2) of the Subdivision Ordinance BACKGROUND: The developer of the Enterprise Subdivision has requested the City Council amend the Subdivision Ordinance to allow right-of-way widths of less than 80 feet. The Ordinance currently reads: "(2) Rights-of-way widths. For all rights-of-way, the widths shall not be less than the following minimum design standards: Parkways, boulevards: One hundred (100) feet Arterials : Eighty (80) feet Collector, residential : Seventy (70) feet Business, industrial areas: Eighty (80) feet Minor, residential : Sixty (60) feet Cul - de - sac , residential : Sixty ( 60 ) feet with fifty-five-foot radius Business alleys: Twenty-four (24) feet Residential alleys: Twenty (20) feet." The developer has submitted the Enterprise Subdivision with right-of-way widths of 60 feet for Wright Circle and for DuPont Circle. These streets will not be through-streets , and Wright Circle will serve a maximum of ten (10) lots. This request has been reviewed by the Municipal Engineer. He has stated that he does not feel that a 60-foot right-of-way is inappropriate as long as use of that width is restricted to streets with low volumes and serving a limited number of lots. His comments are attached and the proposed change is based on those comments. Proposed Change (add to Section 23.22(2) : Right-of-way widths may be reduced as long as the minimum roadway width is maintained and the following minimum parking width can be provided. Street Type Minimum Parking Width Each Side Residential 14.5' Commercial/Industrial 17.5' Parking is defined as the area between the right-of-way line and the street. The proposed change is a means to reduce costs for developers of industrial development. This reduces right-of-way width by 20 feet , thus making more 1 2 land available for development . It allows for the construction of 25-feet-wide streets which is an added savings for the developer. At the meeting on June 19, 1985, the Planning and Zoning Commission took the following action: "MOTION : (Samuels/Soper) to recommend that Section 23.22(2) of the Municipal Code be amended. MOTION PASSED: 5-0." ALTERNATIVES: 1. The City Council can accept the recommendation of the Planning and Zoning Commission to amend Section 23. 22(2) of the Municipal Code and ask the City Attorney to prepare the Ordinance amendment. 2. The City Council can deny the request to amend Section 23.22(2) of the Municipal Code. 3. The City Council can refer this request back to the staff for further review. MANAGER'S RECOMMENDED ACTION: The City Manager recommends that the City Council accept Alternative 1. This alternative will allow for minor industrial/commercial streets to have a minimum right -of -way width of 60 feet and reduce developer costs for industrial/commercial subdivisions. COUNCIL ACTION:
