SUBJECT .- Right of Way widths.
As you know, the CDP for Enterprise 2nd Subdivision includes a request by
the developers to utilize and dedicate a 60' wide right of way and a 25'
wide street. The street width meets the requirements of Seciton 23.22 (3)
of the City Code so it is acceptable. The Code requires that the right of
way for industrial areas be at least 80' in width. Based on this section
(23.22(2) ) the CDP cannot be approved.
However it is important to note that the 80' wide right of way requirement
is probably excessive when the street width is 25' . The public right of
way area is needed to accommodate all of the various utility lines serving
property areas. As a means to allow sufficient area for utilities and
streets, the Public Works Department can accept a modification in these re-
quirements of the ordinance as long as the minimum area is as follows:
Street Type Minimum Parking Width_each side*
Residential 14.5'
Commercial/Industrial 17.5'
This requirement would be in addition to the existing section of the Code
and be utilized for minor service streets only.
The ordinance revision must be completed in order to approve the plat un-
less the City Council wishes to approve the plat concurrent with ordinance
revision.
* Parking is defined as the area between the right of way line and the
street.
