SUBJECT: Additional Proposed Amendments to Retroactive
Conversion Permit Ordinances
In order to clarify the City's intent regarding the proposed retroactive conver-
sion permit ordinance, two wording changes are being

The change being proposed to Section 13.39(3) would make it clear that retro-
active conversion permits would not be considered for issuance unless the City
received application for a retroactive conversion permit before September 1,
1985.
The change which is being proposed to Section 29.52 would make it clear that
structures with retroactive conversion permits would be granted the same noncon-
forming status as other structures in the City as governed by the

Section 29.11 which is attached for your review. Basically, Section29sllns of
mandates that nonconforming structures where the use is discontinued for one
year, or where the structure is destroyed to the extent of 60% or mZ)re of its
replacement cost, must revert back to the use allowed by the present zoning
district classification.
