HomeMy WebLinkAboutA004 - Memo to Council - two additional changes to ordinances, April 19, 1985 M17 N AWN TO: Mayor and ci 1 �1JJ 0 FROM: Paul Wenbe sistant City Manager DATE: April 19, 1985 SUBJECT: Retroactive Conversion Permit Ordinances Attached are two ordinances prepared by City Attorney John Klaus which incorpor- ate the concepts approved by the City Council at the April 2, 1985, meeting con- cerning the issuance of Retroactive Conversion Permits. Ordiance Type I would grant appeal authority solely to the Housing Appeals Board while Ordinance Type II grants appeal authority for non-zoning matters to the Housing Appeals Board and authority for zoning matters to the Zoning Board of Adjustment. City staff is proposing two other changes from the April 2nd Council Action Form which have been incorporated into both ordinances. These changes are as follows: 1. Section 13.39(2) (a) and (b) would allow grandfathering of ceiling height and minimum room size only if certain minimum standards have been met. City staff believes it is prudent to add these minimum standards to those two grandfathered provisions to preclude units with unusually low ceiling heights or small minimum room sizes from receiving Retroactive Conversion Permits. Owners of such properties would still have the option of complying with the provisions as stated in Section 13.39(2) (a) and (b) or receiving an exception through the appeal process. 2. The cutoff date by which property owners must apply for Retroactive Conver- sion Permits has been changed from July 1, 1985, to September 1, 1985. This change is being proposed by City staff in order to provide sufficient time to notify all persons affected by the proposed ordinance of the need to apply for Retroactive Conversion Permits by September 1, 1985. If first reading of the proposed ordinance is scheduled for May 7th, then the ordi- nance could be adopted upon third reading at the May 28th City Council meet- ing. This will allow three months for information to be disseminated through channels such as City utility bills, the "Key to the City," and letters to the 389 property owners on the City's list of suspected conver- sions without building and zoning permits.
