HomeMy WebLinkAbout~Master - Regulating Manufactured Housing LZ�711 `` F INST 41' ORDINANCE NO. 2909 s AN ORDINANCE TO AMEND THE MUNICIPAL CODE AND ZONING ORDINNACE OF THE CITY OF AMES, IOWA, BY ADDING THERETO A NEW SECTION FOR THE PURPOSE OF REGULATING "MANUFACTURED HOUSING" IN A MANNER CONSISTENT WITH THE PROVISIONS OF S.F. 2228 AS ENACTED BY THE 1984 SESSION OF THE SEVENTIETH GENERAL ASSEMBLY OF THE STATE OF IOWA; REPEALING ANY ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT, IF ANY; AND, ESTABLISHING AN EFFECTIVE DATE. WHEREAS, S.F. 2228 as said bill was enacted by the 1984 session of the Seventieth Session of the Iowa General Assembly provides that: "A city shall not adopt or enforce zoning regulations or other ordinances which disallow the plans and specifications of a proposed residential structure solely because the proposed structure is a manufactured home."; and, WHEREAS, with a view to conserving the value of buildings and en- couraging the most appropriate use of land throughout the city so as to promote and protect the general welfare it is deemed prudent to enact regulations pertaining to such "manufactured homes"; NOW, THEREFORE, BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by adding thereto a new section as follows: "Sec. 29.81. REGULATION OF MANUFACTURED HOUSING The purpose of this section and the following subsections is to regulate manufactured housing or the "manufactured home" in a manner consistent with the provisions of S.F. 2228 as enacted by the 1984 session of the Seventieth General Assembly of the State of Iowa. (1) A manufactured home is defined for purpose's of these U�711 regulations as a structure manufactured or constructed INST.NO. so as to conform to provisions of 42 U.S.C. Sections STORY COUNTY, IOWA 5401 through 5403, but which is not constructed with a FILED FOR RECORD permanent hitch or other device allowing it to be moved /AM OCT 17 1984 pW other than for the purpose of moving to a permanent asite, and which does not have permanently attached to SUSAN L. POTTER, Recorder its body or frame, any wheels or axles. A mobile home By Deputy is not a manufactured home unless it has been converted to real property and is taxed as such. BOOK 11 _ PAGE ._S, (2) Although a "mobile home" as defined in subsection 29.2(21) Ames Municipal Code may be so modified and converted as to become a "manufactured home" within the meaning of the Iowa law and these regulations and thereby not be subject to the provisions of Section 29.20, 11R-5" (Mobile Home) District, nothing in this section shall be interpreted or construed as permitting a mobile home at any location other than in an R-5 mobile home district. (3) Neither the provisions of this section, or of section 29.20 of the Ames Municipal Code shall pertain to what is called the "modular home", which is housing built in whole or in part off the site of its occupancy and use and certified by the State of Iowa as meeting the State Building Code. If so certified by the State of Iowa, "modular homes" shall be governed by the same regula- tions and standards as pertain to housing that is built at the site of its occupancy and use. (4) Manufactured homes located outside the aforesaid R-5 (Mobile Home) District shall meet the following minimum standards: (a) The principal portion or main body of such struc- ture shall have a width and length of not less than twenty (20) feet. (b) The siding of such a structure shall consist of wood, simulated wood siding (to include horizontal lapped steel or aluminum siding), brick, stone, stucco or concrete; and, furthermore, shall not have an appearance or condition incompatible with conserving the market value and benificial use and enjoyment of adjacent buildings. (c) Such structure shall have a roof pitch of 2 inches per foot, and all roofs shall have asphalt, wood or similar type shingles with a roof overhang or eave of at least one foot on at least two opposite sides of the structure. (d) Such structure shall conform to all electrical, plumbing, building, fire prevention, rental housing and zoning regulations of the City of Ames except those from which it is clearly exempted by State of Federal law or the provisions of this section. Section Two. Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. 2 BOOK PAGE Section Three. Violation of the provisions of this ordinance shall constitute a misdemeanor punishable by a fine of not more than one hundred dollars or by imprisonment for not more than thirty days. Section Four.
