Paul Goodland, Mayor And Members of the City Council Of the City of Ames , Iowa In re: Ordinance for the Regulation of Dish Antennas Dear Mayor Goodland and Council Members : At this meeting of January 24 , the city council directed the preparation of an ordinance to amend the newly passed ordinance regulating dish antennas so as to allow a maximum height of . sixteen feet rather than ten feet. Attached hereto is the orm of ordinance prepared for that purpose. • The language changes are the result of conversations with an interested citizen and the city manager's office. One matter discussed was the possibility that the antenna might be placed on berms or mounds of earth so as to achieve greater height from the ground. Therefore, the height limitation of sixteen feet has been related to the approximate average elevation from sea level of the land in the rear yard of the lot. Since the antenna must be at least ten feet from any main building existing or under construction on the same lot, it cannot be located on the roof of the house. Given very unusual topography o the rear yard, it may to place an antenna on some other kind of structure if in doing so the top of the antenna will not be more than sixteen feet in height above the approximate average elevation from sea level of the land in the rear yard of the house. The ordinance permits an antenna on the roof of a building in a commercial district. Fertile imaginations may yet conceive of some other way in which to do something disagreeable with a dish antenna. If and when such occurrences take place, the council will have the option of considering further revisions to prevent a reoccurrence. • Respectfully submitted, John R. AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSEC- TION 29.76(2) AS IT NOW EXISTS AND ADOPTING A NEW SUBSECTION 29.76(2) FOR THE PURPOSE OF INCREASING THE MAXIMUM HEIGHT ALLOWED FOR "DISH" ANTENNAS; PROVIDING A PENALTY, REPEALING ALL ORDINANCES OR PARTS OF ORDI- NANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT, IF ANY; AND, ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing Subsection 29.76(2) as it exists and enacting a new subsection 29.76(2) as follows: "(2) "Dish" Antennas. (a) "Dish" antennas installed in residential zoning districts for reception of television and/or other signals from orbiting Earth satellites or other sources shall not exceed sixteen (16) • feet in height above the approximate average elevation from sea level of the land in the rear yard of the lot on which it is located, measured to the highest point on any part of the installed apparatus pertaining to such antenna; shall be located in the rear yard of the lot; shall be at least ten (10) feet from any main building existing or under construction on the same lot; shall be at least five (5) feet from any rear or side property line; and, in the case of a corner lot, shall not project beyond the front yard required or existing on the adjacent lot. (b) In the case of an interior lot abutting upon two or more streets, a ""dish"" antenna shall not be erected or altered so as to encroach upon the one-quarter of the lot nearest either street or in any case, the front yard required for either street. (c) In any commerical or industrial district, a "dish" antenna shall not exceed forty-five (45) feet in height nor be located closer than fifteen (15) feet to any public street. If used for advertising purposes, a "dish" antenna shall be deemed to be a sign and shall also be governed by the sign regulations applicable to the property. A "dish" antenna may be mounted on the roof of a building, in a nonresidential zoning district, but it shall not extend more than sixteen (16) feet above the height limit established for the district in which the structure is located and shall not be used for advertising purposes." Section Two. Violation of the provisions of this ordinance shall consti- tute a misdemeanor punishable by fine not to exceed one hundred dollars or by imprisonment not to exceed thirty days.
