RE: Docket No. 85-87, Preemption of Local Zoning Regulations of
Receive-Only Satellite Earth Statons
Dear Mr. Tricarico:
The City of Ames expresses its strong opposition to plans recently
announced by the Federal Communications Commission which would effectively
preempt state and local zoning ordinances which discriminate against satel-
lite earth station facilities. We view this as an attempt by the FCC to
interfere with the exercise of our City's basic governmental zoning powers
which allow us to exercise control over the uses of land within our City
limits.
The City's zoning ordinance regulating the placement of satellite dishes
was enacted after receiving thoughtful input from many diverse elements
within our City. These regulations reflect the distinctive approach which
our City's residents have chosen to take regarding the placement, use, and
unobtrusiveness of these earth station facilities. %b have further recog-
nized that commercial (cable television franchise-holder) earth station
facilities located in an industrially zoned area should indeed be subject
to different standards than satellite dishes located in residential neigh-
borhoods. These are subjects of local concern and authority which should
not be abridged by federal regulations.
We respectfully ask that the members of the Federal Communications Commis-
sion recognize the objections to this proposed rule, and that they will
instead leave local zoning decisions in the hands of those governments
which are closest to the citizens being affected.
