IpWA MEETING DATE:��15/g� V COUNCIL ACTION FORM I SUBJECT: Rezoning a parcel located at 1110 Delaware Avenue from R-2 (Low Density Residential) to R-3 (Medium Density Residential) BACKGROUND: This is a request to rezone a parcel of land located at 1110 Delaware Avenue from R-2 to R-3. Currently, the property is occupied by a single family structure. The applicant has indicated that the property is under contract to sell if the zoning is changed to R-3. The prospective purchaser has indicated that a twelve unit structure will be constructed on the site. Rezoning the property from R-2 to R-3 would increase the maximum number of units that can be constructed on the property from 6 units to 12 units. This request was on the Planning and Zoning Commission agenda for November 2, 1983. At that meeting a petition was submitted in opposition to the rezoning request. A copy of that petition is attached along with a map delineating the 200' area. Properties crosshatched on the map indicate property owners in opposition to this request. Owners of 10% of the area within 200' have signed the petition in opposition, thus a simple majority vote of the City Council would be required to adopt this zoning change. During the Commission review of this request, the Commission responded to the concerns expressed by the petition signees concerning potential appearance of a twelve unit building. The Commission felt that additional screening could be provided along the east side of the subject property to provide a visual barrier from the properties on the east side of North Dakota Avenue. In reviewing this request, the Commission discussed the following points: 1. The Land Use Policy Plan designates the property for medium density residential uses. 2. The current use as a single family structure is not the "highest and best use" for the property. 3. Changing the zoning from R-2 to R-3 will increase the allowable unit density from 6 units to 12 units. The Planning and Zoning Commission took the following action: MOTION: (Fouts/Soper) To approve the rezoning request from R-2 to R-3, and urge the developer to provide adequate screening along North Dakota Avenue. Motion carried unanimously. + � � 2 • ` If this rezoning request from R-2 to R-3 is approved, there are additional site plan review requirements which will have to be satisfied. At the time a request is submitted for a building permit, the site plan will be reviewed by the appropriate City departments. This review includes review of the proposed landscape plan, and adequate screening along North Dakota Avenue will be a necessary item for approval. ALTERNATIVE: 1. Accept the Commission recommendation and set a date for Public Hearing. 2. Reject the Commission recommendation. 3. Modify the Commission recommendation. MANAGERS RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council accept Alternative 1 which will result in a zoning change from R-2 to R-3, and set the date for Public Hearing for December 6, 1983.
