BACKGROUND: Earlier this year the resident of 1004 Ridgewood requested a side yard variance from the Zoning Board of Adjustment to facilitate construction of an accessory structure in the portion of his lot adjacent to loth Street. As shown on the attached map, loth Street east of Ridgewood is a dead end street only one lot deep. The Zoning Board of Adjustment requested that the property owner pursue downgrading of the street to an alley. This is necessary since the property on the south side of loth Street has a garage that has access off of loth. Staff has reviewed the situation and no plans exist for extensions or improvements of loth Street across the CNW railroad tracks. However, utilities do exist within the present 50' wide street right of way. Planning & Housing personnel received three calls form area residents in opposition to the side yard variance when the question was before the Zoning Board of Adjustment. ALTERNATIVES: 1. Reject the request for downgrading of the street and return the request to the Zoning Board of Adjustment for final action. 2. Accept the request for downgrading the street by setting September 13, 1983, as the date of public hearing and for first reading of ordinance to vacate the north 13.0' and the south 13.0' of loth Street between Ridgewood and the CNW railroad tracks and designating the center 24' as an alley. Easements for public utilities should be retained over the vacated portions. MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council adopt alternative number 2 above. COUNCIL ACTION: APp 0 N' 8Y C00t4c 23 �1
