SUBJECT: Change in Municipal Code (Section 23.1) to permit the issuance of
up to two (2) building permits after approval of an administrative
plat.
BACKGROUND:
During the Council meeting of July 12, the subject of the issuance of up to
two (2) building permits prior to completion of the final plat was referred
to staff.
For as many years as any staff member can recall, the City of Ames issued up
to two (2) building permits within a proposed subdivision after approval of
the "preliminary" plat. The former "preliminary" plat is substantially the
same plat as what is now referred to as an administrative plat. The
administrative plat is the second phase of the platting process following
the approval of a conceptual development plan by both the Planning
Commission and City Council. The administrative plat also takes on the same
configuration as the final plat. The attached ordinance, if approved by the
City Council, would permit "one or two building permits" in each area where
an administrative plat has been approved.
The advantage to developers of subdivisions with this procedure is to permit
concurrent building of both subdivision improvements as well as marketable
buildings. Since substantial time is required for the construction of
subdivision improvements, homes can also be built before any title transfers
are necessary. Thus, there is a reduction in the amount of funds necessary
for the performance bond and more rapid return on the investment prior to
completion of the plat.
ALTERNATIVES:
1. Make no changes in the ordinance and thus permit no building permits
prior to the filing of a final plat.
2. Approve the ordinance and thus permit up to two (2) permits following
the approval of the administrative plat for a new subdivision.
RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council approve
alternative #2 by amending the platting ordinance to permit up to two (2)
building permits in an area following approval of the administrative plat.
COUNCIL ACTION:
