Klaus , City Attorne* DATE : May 24 , 1983 SUBJECT : Proper Zoning District for Bacteriology Laboratory This is in response to your memo of May 19 , subject as above , in which you asked if a "bacteriology laboratory" is a per- mitted use in the P-C zoning district. As you undoubtedly know under the present zoning ordinance , "laboratory" is an expressly permitted use only in the General Industrial and Planned Industrial zoning districts . "Laboratory- Medical and Dental" is an expressly permitted use in the Hospital- Medical district. Years ago "laboratories" were on expressly permitted use in the old C-2 through C-4 districts, but not in the C-5 district. P-C is the descendant of and heir to many of the policies of the old C-5 district. In other words , this City has never expressly permitted "laboratories" in its planned commerical district. By contrast, "laboratory" has been a permitted use in other commercial districts and would, in most instances , fit easily under the "commercial services" rubric of the present day General Commercial and Concentrated Commercial districts . However, if this "laboratory" is to be in the basement of a duplex, it would seem to be a very small scale activity, much akin to a physician, dentist or other health field practitioner' s office, and therefore a use that could perhaps be accepted in the P-C district under the rubric of "professional office" . bw
