HomeMy WebLinkAboutA004 - Council Action Form, May 17, 1983 ITEM #_ D/O May 17, 1983 COUNCIL ACTION FORM SUBJECT: Rezone property located at 221 Welch Avenue from R-4 (High-Density Residential ) to P-C (Planned Commercial ) BACKGROUND: This rezoning request is for the purpose of using the subject parcel as parking for the McDonalds Restaurant which will be constructed on the parcel to the north. That parcel is currently zoned C-C (Concentrated Commercial ) and is occupied by the vacant International House of Pancakes building which will be demolished. The subject parcel at 221 Welch Avenue is in an area designated for commercial development in the Land Use Policy Plan. The area has. been .recommended for rezoning to P-C by the Planning and Zoning Commission as a part of the proposed community-wide zoning changes. The Council agreed with that recommendation at the meeting of April 26, 1983. The Planning and Zoning Commission reviewed this rezoning request at its meeting on May 4, 1983. The Commission, at that time, also reviewed the site plan, impermissible uses, and the plan documentation. All of these items are attached. The list of impermissible uses for this property at 221 Welch includes all uses except a parking lot associated with the restaurant to be constructed on the lot at 217 Welch. The Commission took the following action: MOTION: (Manatt/Zingg) Move we approve the request and include the lots to the south and west. Motion carried unanimously. The motion is the Commission 's recommendation to the City Council to approve , at this time, the rezoning, list of impermissible uses, site plan, and plan documentation for 221 Welch Avenue. The lot to the west, 2513 Hunt Street, was referred to the Planning and Zoning Commission by City Council on May 3, 1983. The applicant is currently processing site plan materials for further Commission consideration and will be formally transmitted to Council at a future date. The lot to the south, 223 Welch, has. not made a formal request for rezoning. The property owner will be contacted for future processing of the rezoning. ALTERNATIVES: 1 . To approve the request for rezoning from R-4 to P-C at 221 Welch. This includes the list of impermissible uses, site plan, and plan documentation. 2. To deny the request for rezoning from R-4 to P-C at 221 Welch. MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council accept Alternative No. 1-- to accept the recommendation of the. Planning and Zoning Commission for rezoning from R-4 to P-C--and to set the public hearing date for June 7, 1983. This recommendation includes the list of impermissible uses, site plan, and plan documentation. CITY COUNCIL ACTION:
