HomeMy WebLinkAbout~Master - Placing Responsibility for Rabies Determination with City Manager ORDINANCE NO. 2850 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SECTIONS 3. 10 AND 3.11 AS THEY PRESENTLY EXIST AND ENACTING NEW SECTIONS 3.10 AND 3. 11 FOR THE PURPOSE OF PLACING THE RESPONSIBILITY PRE- VIOUSLY HELD BY THE CITY SANITARIAN FOR RABIES DETERMINATION WITH THE CITY MANAGER OR DESIGNEE TO REFLECT THE CURRENT CITY'S ORGANI- ZATIONAL STRUCTURE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND ESTABLISHING AN EFFECTIVE DATE BE IT ORDAINED by the City Council of the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa, is hereby amended by repealing Sections 3.10 and 3. 11 as they have existed and enacting new Sections 3. 10 and 3.11 as follows: "Sec. 3. 10. CONFINEMENT FOR RABIES DETERMINATION. When the City Manager or designee shall receive information that any person has been bitten by an animal or that an animal is suspected of having rabies, the City Manager or designee shall order the keeper to surrender such animal for confinement, for a period not to exceed 14 days, in the manner than directed, at the keepers' expense. Failure or refusal to obey such order immediate- ly shall constitute a violation of this section. Confinement shall be at the City of Ames animal shelter, or some other facility operated by a licensed veterinarian in Story County. At the discretion of the City Manager or designee it is permissible to allow confinement at the home of the animal's keeper, but only if the City Manager or designee is convinced that the animal will be secure and so penned as to prevent the intimate approach of any other animal or person. The City Manager or designee shall afford the keeper a hearing and make a determination on whether the animal can be confined at the keeper's home as soon as possible, but not later than the close of business on the third day following the surrender of the animal for confinement. Sec. 3. 11. HARBORING, FAILING TO REPORT SUSPECTED CASES. It is unlawful for any person to knowingly harbor or keep any animal infected with rabies, or any animal which is suspected to have been bitten by a rabid animal. It is unlawful for any person y � 2 to fail to report to the City Manager or designee or the police department the existence of any dog, cat or other animal which they know or suspect to be rabid. It is unlawful for any person keeping an animal which has bitten or attacked a person, or any person having knowledge of such bite or attack to fail to imme- diately report the same to the City Manager or designee." Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict if any. Section Three. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Section Four. Violation of the provisions of this ordinance shall be punishable as a simple misdemeanor by a fine not to exceed one hundred (100) dollars or by imprisonment for a period not to exceed thirty (30) days.
