HomeMy WebLinkAboutA007 - Council Action Form, July 12, 1983 ITEM # p{o� DATE: July 12, 1983 COUNCIL ACTION FORM SUBJECT: License Fee for Street Vendors BACKGROUND: According to the street vending ordinance recently passed by the City Council , the City Council has the responsibility for setting the street vending license fee. Section 22.21 of the street vending ordinance which is attached, states that the license fee shall be based upon the direct and indirect costs of administration, inspection and enforcement of the street vending ordinance. Administration and inspection activities will consist of semi-annual inspections of each vending stand by the City Sanitarian and an annual license issuance by the City Clerk' s Office. It is estimated that these activities will result in $30.00 worth of personnel and materials expense annually per vending stand. It is certain that the administration and inspection expenses previously described will be incurred. However, enforcement expenses will be incurred only if there are violations of the ordinance. Therefore, it is felt that it is neither equitable nor practical to assign any potential enforcement costs associated with this ordinance to the license fee. It should be noted that a staff recommendation was made to the Advisory Committee on Business Districts at their March 24, 1983 meeting prior to having any opportunity to make a calculation of the actual costs of administering this ordinance as specified in section 22.21. The staff recommendation to the Advisory Committee on Business Districts was that a fee of $40.00 be established for the street vending license because it is equivalent to the fee paid by restaurants with annual sales of less than $50,000.00. The intent of this recommendation was to equate the fee for street vendors with those imposed on the smallest restaurant classification. The Advisory Committee on Business Districts did adopt the original staff recommendation to establish a street vending fee of $40.00 at their March 24 meeting as indicated in the attached minutes of that meeting. ALTERNATIVES: 1 . Adopt the present staff recommendation establishing a street vending license fee of $30.00 which is consistent with section 22.21 of the street vending ordinance. 2. Adopt the original staff recommendation establishing a $40.00 license fee which was based on making the license fee for street vendors equivalent to those of restaurants with annual sales of less than $50,000.00. MANAGER' S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council select alternative #1 which would set the street .1.ise fee at $30.00. APPROVED BY COUNCIL - COUNCIL ACTION: FJl�T2 1983 r , (3) Conduct of the licensed business in such manner as to create a public nuisance, or constitute a danger to the public health, safety, welfare or morals. (4) Conduct which is contrary to the provisions of this ordinance. Sec. 22.21. FEE A fee for the license and inspection shall be charged based upon the direct and indirect costs of administration, inspection, and enforcement as set by resolution of the City Council. Sec. 22.22. STANDARDS FOR VENDING. The following standards shall be observed by all vendors: (1) The vending stand shall be of such a size and so placed that it does not obstruct the orderly flow of pedestrian and/or vehicular movement(s). (2) The vending stand shall be placed so as not to obstruct visibility at street intersections or to obstruct driveway entrances. (3) All vending stands shall provide a litter receptacle which is available for the vendor's patron's use. (4) All vending stands shall be attended at all times and removed during hours of nonoperation. (5) Upon removal of the stand, all litter and trash shall be picked up. (6) Vending items shall be only those stated in the applica- tion. (7) The vending stand shall be placed so as not to obstruct the view of merchandising displays of other businesses abutting the sidewalk. (8) All vending from motor vehicles shall be conducted in such a way as not to restrict or interfere with the ingress or egress of the abutting property, create a public nuisance, increase traffic congestion or delay, constitute a hazard to traffic, life, or property, or be an obstruction to adequate access to fire, police, or sanitation vehicles. In the cases of vending of foods or beverages, all vending businesses shall be inspected at least twice each year. All vending licenses and inspection certificates shall be displayed at all times during operation of the business. This licenses will be effective for one year from the date of issuance.
