HomeMy WebLinkAbout~Master - Amending Noise Ordinance ORDINANCE NO. 2848 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING AND ENACTING A NEW SUBSECTION 16.5(1) PERTAINING TO VEHICLE SOUND LIMITS, SECTION 16.7 PERTAINING TO MAXIMUM SOUND LEVELS WITH PERMITS, AND SUBSECTION 16.4(4) PERTAINING TO THE DISTANCE FOR MEASUREMENT AND MAXIMUM SOUND LEVELS FOR SOURCES WITHOUT PERMITS; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY, AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Counil for the City of Ames, Iowa: Section One. The Municipal Code for the City of Ames, Iowa, shall be and is hereby amended by repealing subsection 16.5(1) thereof and enacting a new subsection 16.5(1) as follows: "(1) The maximum allowable sound levels for motor vehicles shall be 84 dB(A) measured at a distance of twenty-five feet. " Section Two. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing Section 16.7 and enacting a new Section 16.7 as follows: "See. 16.7 MAXIMUM SOUND TO BE PERMITTED. When a permit has been issued pursuant to this chapter the sound levels listed in the following table shall be the maximum levels permitted: Sound Level Limit in dB(A) Duration 80 24 hrs 83 12 hrs 86 6 hrs 89 3 hrs 90 1.5 hrs The above stated duration for each sound level shall not be ex- ceeded. The sound level shall be measured at a distance of fifty (50) feet from the sound source. Sound in excess of 90 dB(A) shall at all times be unlawful. " Section Three. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing subsection 16.4(4) and enacting a new subsection 16.4(4) as follows: "(4) For the purposes of determining and classifying any sound as excessive or unusually loud, the following test measurement and requirements are to be applied: 2 (a) The sound shall be measured at the edge of the city street or alley right-of-way reasonably appearing to be nearest to the source of the sound. (b) The sound shall be measured on a sound level meter of standard design and quality operated in the "A" slow response weighing scale. (c) A sound measured or registered in excess of the maximum permitted levels according to the following table, is declared to be excessive and unusally loud and is unlawful. Violation of the provisions of this ordinance shall con- stitute a misdemeanor punishable by a fine not to exceed $100.00 or by imprisonment for a period not to exceed 30 days. Section Five. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section Six. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this 3rd day of May 1983. Ginj Bicknese, City Clerk F.
