REQUESTED ACTION: Rezone from R-2 (Low-Density Residential) to H-M (Hospital-
Medical)
PURPOSE FOR REQUEST (as stated by Applicant) : "Future expansion needs of
adjacent dental practice."
LOCATION: 118 East 13th Street
LEGAL DESCRIPTION: Emery Subdivision, East 40 feet of Lot 4; West 9.5 feet,
North 132 feet of Lot 3; West 24 feet, South 66 feet of Lot 3.
SIZE: + 10,758 sq. ft.
EXISTING LAND USE & ZONING:
North: Residential; R-2
South: Dental Clinic; H-M
East: Residential; R-2
West: Dental Clinic; H-M
FINDINGS:
Land Use Policy Plan
The subject property is in a transition area between the Hospital-Medical
designation and the Low-Density designation, and it is difficult to
determine which designation is applicable to this particular lot.
Zoning History
The lot has been zoned R-2 since 1965 when the current zoning classifica-
tions were adopted.
Public Utilities
Water -- 6" water line in East 13th Street
Sanitary Sewer -- 8" sanitary sewer line in East 13th Street
Storm Sewer -- 33" storm sewer line in East 13th Street

Vehicular Access
Access is provided from East 13th Street.
Physical Characteristics
Vegetation -- Types generally found in areas developed for urban purposes.
Terrain -- Generally flat.
Drainage -- Generally to the east and south.
Soils -- N/A
Flooding -- Not subject to flooding.
ANALYSIS:
1. As noted, the subject property is located in the transition area
between the H-M zone and R-2 zone, and the actual designation of
the lot is a matter for interpretation by the Commission.
2. The subject property is adjoined on the west and south by property
zoned H-M. If the east boundary line of the H-M district south of
the subject property were extended north, the subject property would
be included in the H-M zone.
3. The subject property is to be used for future expansion of the
adjacent dental clinic and not for construction of a new clinic.
The same situation existed when the lot to the south was rezoned
H-M so it could be included as part of the development of the
dental clinic at 1212 Duff Avenue.
RECOMMENDATION:
The Department of Planning and Housing recommends that this request be
approved.
