In Re: Ordinance Pertaining to the Regulation of Salvage Yards, the
Keeping of Wrecked and Demolished Vehicles, and the Outdoor
Storage of Motor Vehicles
Dear Mayor Goodland and Council Members:
With this find a form of ordinance reflecting the considerations of city
staff, the Planning & Zoning Commission and the Zoning Board of Adjust-
ment and the amendments and changes suggested by the City Council and
interested citizens.
This ordinance will have applicability to all of the situations involv-
ing so-called "junk cars" that have been brought to my attention. It
also contains the exceptions previously discussed with the City Council.
The salvage yard regulations are not restricted to commercial salvage
yards and can, at least in theory, be applied to the individual who en-
gages in that sort of thing on a non-commercial or "hobby" basis.
A civil suit for injunction will be the preferred method for enforce-
ment. That method is authorized under Iowa law for enforcement of zoning
regulations. However, "parking-ticket" type citations may be used in
simple, clear-cut, situations.
Procedures and techniques for enforcement of this ordinance will need to
be worked out in consultations between the City Manager's staff and the
City Attorney's office.
