HomeMy WebLinkAbout~Master - Changing Requirement for Board Meeting Within 30 Days of Hearing Application y ORDINANCE NO. 2817 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTION 13. 16 AND ENACTING A NEW SUBSECTION 13. 16 ALL FOR THE PURPOSE OF CHANGING THE REQUIREMENT FOR A BOARD MEETING WITHIN THIRTY (30) DAYS OF ANY APPLICATION FOR A HEARING; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT, IF ANY; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ORDAINED, by the City Council for the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing subsection 13. 15 and enacting a new subsection 13. 15 to read as follows: "Immediately upon appointment, members of the housing appeal board shall organize and select one member as chair and one as vice-chair. The city clerk or deputy city clerk shall serve as secretary of the board. The city attorney shall be the attorney for the record. The housing appeal board shall adopt , from time to time, subject to the approval of the city council, such rules and regulations as it may deem necessary to carry into effect the provisions of this chapter." Section Two. The Municipal Code of the City of Ames, Iowa, shall be and is hereby amended by repealing subsection 13. 16 thereof and enacting a new subsection 13. 16 to read as follows: "Except for the annual meeting in April of each year to elect a chair and vice-chair, the board shall meet at the call of the chair, or in the absence of the chair, the vice-chair, and within forty-five (45) days of any application for a hearing to consider appeals from decisions of the housing inspector rendered pursuant to the provisions of this chapter; or, an application for repair and deduct or rent escrow. The presence of three (3) members of the board shall be necessary to constitute a quorum. The concur- ring vote of three (3) members shall be necessary to overrule the decision of the housing inspector." Section Three. Any and all ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such conflict, if any. Section Four.
