COUNCIL ACTION FORM
NO: November 2.4, 1981
SUBJECT: Downzoning. "Grandfathering," certain existing duplexes in R1-6 districts.
BACKGROUND: The attached proposed amendment to the zoning ordinance is a possible
alternative to many of the concerns expressed as a result of the recent cases
involving downzoning of neighborhoods. Thy "tug-of-war" which has been created is
very difficult to reconcile in favor of one side or the other. The apparent theme
of those neighborhoods requesting downzoning is "no more duplexes" not "get rid
of the duplexes that exist." The opposing theme of the landlords is "you're takine
away a basic right." The attached amendment attempts to satisfy both themes. The
amendment permits, by right, those duplexes under construction prior to a certain
point in time (suggested July 1, 1980) , thereby eliminating their potential legal
nonconforming status.
ALTERNATIVES:
1. Refer the proposed amendment to the Planning and Zoning Commission for
review and recommendation.
2. Do not refer the proposed amendment and maintain the zoning ordinance
in its present form.
CITY MANAGER'S RECOMMENDATION: Refer the proposed amendment to the Planning and
Zoning Commission for review and recommendation.

Sec. 29.15 RI-6, Low-Density Residential District.
Statement of Intent. This district is intended to provide for low-density
residential areas with single-family dwellings and certain existing two-family
dwellings.
(1) Permitted Uses. A building or premises shall be used only for the
following purposes:
Single-family dwellings
Two-family dwellings if under construction prior to (July 1, 1980)
and if built as a two-family dwelling as evidenced by the plan
on file with the Chief Building Official.
Places of worship
Cemetery
Golf course, except miniature golf courses and driving ranges operated
for commercial purposes
Country club
Private schools having curriculum similar to that offered by public
schools
(2) Bull: Regulations. The following minimum requirements shall be observed:
(a) Lot Area Single-family dwellings-6,000 sq. ft.
(b) Lot Width Single-family dwellings at street line -
35 feet
Single-family dwellings at building line -
50 feet
(c) Front Yard 25 feet minimum
(d) Side Yard 6 feet for one story
8 feet for two stories
10 feet for three stories
15 feet on street side for corner lot except
when additional side yard is required to
prevent motor vehicles from parking on the
sidewalk.
(e) Rear Yard 20 feet minimum
(f) Maximum Height 3 stories or 40 feet
(3) Off-Street Parking Requirements. Two per unit required in all single-
family dwellings; and all other permitted uses as required in Sec. 29.40.
Occupancy of a single dwelling unit or of a structure designed and built as a
single-family dwelling by more than three adult persons not related by marriage or
consanguinity is prohibited and shall constitute a violation of this section.
