SUBJECT: Amendment to the Subdivision Ordinance
BACKGROUND:
The City's Subdivision regulations require that the developer or owner of any
subdivision must install the necessary improvements required by the City prior
to receiving final plat approval . If these improvements cannot be accomplished
prior to the final plat approval , then the owner must file a corporate surety
bond or certified check in an amount to cover these improvements. The sub-
division requires that these improvements be completed within two years after
approval of the final plat.
With the slowdown of construction activities in the last year and one half, we
have many platted subdivisions that are approaching the two-year deadline for
installation of these improvements.
Attached for Council review is an Amendment to the Subdivision Ordinance which
would allow for the City Council to grant an extension of time for completion
of improvements in subdivisions.
ALTERNATIVES:
Approve the attached amendment to the Subdivision Ordinance. This provision
will allow for the Council to grant a two-year extension and would also require
a new bond to be filed with an updated estimate for cost of improvements.
Do nothing. The requirement for improvements to be installed within two years
would still apply.
MANAGER'S RECOMMENDED ACTION:
It is recommended that the City Council adopt the attached Amendment.
