H.F. 1 Section 1 . Section 40.1, Code 1981, is amended to read 2 as follows : 3 40 .1 DISTRICTS DESIGNATED. The state of Iowa is hereby 4 organized and divided into six congressional districts, which 5 shall be composed, respectively, of the following counties : 6 1. The first district shall consist of the counties of 7 BeRtea7-Poweskiek7-iewa7-dekMeea7 Scott, Mahaska, Keokuk, 8 Washington, Louisa, Muscatine, Lucas, Monroe, Wapello, 9 Jefferson, Henry, Des Moines, Appanoose, Davis, Van Buren 10 and Lee. 11 2 . The second district shall consist of the counties of 12 WiRmeshiek7 Allamakee, Fayette, Clayton, Buchanan, Delaware, 13 Dubuque, Linn, Jones, Jackson, Cedar and Clinton. 14 3 . The third district shall consist of the counties of 15 Worth, Mitchell, Howard, Haxeeek7-8erre-Garde Winneshiek, 16 Floyd, Chickasaw, Wright7-Franklia7 Butler, Bremer, Hax►iltex7 17 Hard}A- Grundy, Black Hawk, Bxekamam Marshall, aad TamaL 18 Benton, Poweshiek, Iowa and Johnson. 19 4. The fourth district shall consist of the counties of 20 Hamilton, Boone, Story, Dallas, Polk; and Jasper7-MaFiea7 21 Makaeka7-KeekukT-LucasT-Mexree7-Wapelle7-AppaReese-aad-Bavie . 22 5. The fifth district shall consist of the counties of 23 Sac, Calhoun, Webster, Crawford, Carroll, Greene, BeeRe7 24 6tery- Harrison, Shelby, Audubon, Guthrie, Ba11ae7 25 Pottawattamie, Cass, Adair, Madison, Warren, Marion, Mills, 26 Montgomery, Adams, Union, Clarke, Fremont, Page, Taylor, 27 Ringgold, Decatur and Wayne. 28 6. The sixth district shall consist of the counties of 29 Lyon, Osceola, Dickinson, Emmet, Kossuth, Winnebago, Sioux, 30 O'Brien, Clay, Palo Alto, Hancock, Cerro Gordo, Plymouth, 31 Cherokee, Buena Vista, Pocahontas, Humboldt, Wright, Franklin, 32 Woodbury, Ida, 6ae--ealkeuRT-Webeter7 Hardin, and Monona axd 33 BEawferd. 34 Sec. 2 . Section 41 .1, Code 1981, is amended by striking 35 the section and inserting in lieu thereof the following: -1- S .F. H.F. 1 41 .1 REPRESENTATIVE DISTRICTS. The state of Iowa is 2 hereby divided into one hundred representative districts, 3 as follows : 4 1. That portion of Muscatine county not contained in the 15 fifty-sixth representative district. 16 b. In Scott county, Liberty, Allens Grove, Winfield, 17 Cleona, and Buffalo townships, the cities of Blue Grass, 18 Plainview, and Walcott, and that portion of Sheridan township 19 not contained in the thirty-ninth or fifty-eighth 20 representative district. 21 58. The fifty-eighth representative district shall consist 22 of the following portions of Scott county: 23 a. Those portions of Hickory Grove and Blue Grass townships 24 lying outside the corporate limits of the cities of Davenport, 25 Plainview, Walcott, and Blue Grass . 26 b. That portion of the city of Davenport bounded by a 27 line commencing at the point of intersection of Zenith avenue 28 and West Locust street, then proceeding north along Zenith 29 avenue until it intersects West Garfield street, then 30 proceeding east along West Garfield street until it intersects 31 Fairmount street, then proceeding south along Fairmount street 32 until it intersects West Central Park avenue, then proceeding 33 east along West Central Park avenue until it intersects North 34 Howell street, then proceeding north along North Howell street 35 until it intersects Hayes street, then proceeding east along -38- S.F. H.F. 1 a line commencing at the point of intersection of the north 2 extension of Gnahn street and the corporate limits of the 3 city of Burlington, then proceeding first southeasterly and 4 then in a clockwise manner along the corporate limits of the 5 city of Burlington until it intersects the east extension 6 of Linden street, then proceeding first west and then in a 7 counterclockwise manner along the boundary of the sixtieth 8 representative district to the point of origin. 9 60 . The sixtieth representative district shall consist 10 of the following portions of Des Moines county: 11 a. Flint river township and cities of West Burlington 12 and Middletown. 13 b. That portion of Keokuk county not contained in the 24 sixty-third representative district. 25 b. Mahaska county. 26 C. In Wapello county, Columbia, Cass, and Highland 27 townships and that portion of Richland township lying outside 28 the corporate limits of the city of Ottumwa. 29 65 . The sixty-fifth representative district shall consist 30 of those portion of Center township and the city of Ottumwa 31 bounded by a line commencing at the point of intersection 32 of the north boundary of Center township and the east corporate 33 limit of the city of Ottumwa, then proceeding first east and 34 then south along the boundary of Center township until it 35 intersects the corporate limits of the city of Ottumwa, then -41- S .F. The sixty-ninth representative district shall consists 24 of Marion county, except Red Rock township. 25 70 . The seventieth representative district shall consist 26 of: 27 a. That portion of Warren county not contained in the 28 sixty-eighth representative district. 29 b. That portion of Marion county not contained in the 30 sixty-ninth representative district. 31 C. In Jasper county, Clear Creek, Independence, Poweshiek, 32 Sherman, Washington, Mound Prairie, Des Moines, and Fairview 33 townships. 34 d. In Polk county: 35 (1) Washington, Franklin, Beaver, Camp, and Four Mile -42- S.F. H.F. 1 townships, the cities of Bondurant and Pleasant Hill, and 2 that portion of Allen township lying outside the corporate 3 limits of the cities of Des Moines and Pleasant Hill . 4 (2 ) That portion of Delaware township bounded by a line 5 commencing at the point of intersection of the north corporate 6 limit of the city of Pleasant Hill and the east corporate 7 limit of the city of Des Moines, then proceeding first west 8 and then east along the corporate limits of the city of Des 9 Moines until it intersects the west corporate limit of the 10 city of Pleasant Hill, then proceeding first east and then 11 north along the corporate limits of the city of Pleasant Hill 12 to the point of origin. 13 71 . The seventy-second representative district in Marshall 20 county shall consist of Jefferson and Timber Creek townships, 21 the city of Marshalltown, and that portion of Marietta township 22 contained within the perimeter of the corporate limits of 23 the city of Marshalltown. 24 73 . The seventy-third representative district in Story 25 county shall consist of Grant, Nevada, New Albany, Union, 26 Indian Creek, and Collins townships, the city of Kelly, and 27 those portions of Washington township and the city of Ames 28 not contained in the seventy-fourth representative district. 29 74. If a vacancy in the general assembly occurs or 13 exists after the effective date of this Act at a time which 14 makes it necessary to fill the vacancy at a special election 15 held pursuant to section 69 . 14, the vacancy shall be filled 16 from the same district provided in chapter 41, Code 1981 , 17 that elected the senator or representative whose seat is 18 vacant. This section does not apply if a special election 19 is not required under section 69. 14 and is repealed January 20 1, 1983. 21 sec. 4. The membership of the senate and the house of 22 representatives in the seventieth and subsequent general 23 assemblies shall be determined as follows : 24 1 . Each representative district established by section 25 2 of this Act shall elect one representative for a term of 26 two years in 1982 and every subsequent even-numbered year. 27 2 . Each odd-numbered senatorial district established by 28 section 41 .2, which the general assembly adopts by reference, 29 and section 2 of this Act shall elect a senator in 1982 for 30 a four-year term commencing in January, 1983 . If an incumbent 31 senator who was elected to a four-year term which commenced 32 in January, 1981, or was subsequently elected to fill a vacancy 33 in such a term, is residing in an odd-numbered senatorial 34 district on April 2, 1982, that senator' s term of office shall 35 be terminated on January 1, 1983 . -57- S.F. H.F. 1 3 . Each even-numbered senatorial district established 2 by section 41 .2, which the general assembly adopts by 3 reference, and section 2 of this Act shall elect a senator 4 in 1984 for a four-year term commencing in January, 1985 . 5 a. If one and only one incumbent state senator is residing 6 in an even-numbered senatorial district on April 2, 1982, 7 and that senator was elected to a four-year term which com- 8 menced in January, 1981 or was subsequently elected to fill 9 a vacancy in such a term, the senator shall represent the 10 district in the senate for the Seventieth General Assembly. 11 b. Each even-numbered senatorial district to which para- 12 graph a of this subsection is not applicable shall elect a 13 senator in 1982 for a two-year term commencing in January, 14 1983 . 15 Sec. 5 . For purposes of this Act, each reference to a 16 specific city or township means the city or township as its 17 bour,odiies -xisted on April 1, 1980, the official date of 18 the 1980 United States decennial census . 19 Sec. 6.
