1 Section 1 . Section 40.1, Code 1981, is amended to read
2 as follows :
3 40 .1 DISTRICTS DESIGNATED. The state of Iowa is hereby
4 organized and divided into six congressional districts, which
5 shall be composed, respectively, of the following counties :
6 1. The first district shall consist of the counties of
7 BeRtea7-Poweskiek7-iewa7-dekMeea7 Scott, Mahaska, Keokuk,
8 Washington, Louisa, Muscatine, Lucas, Monroe, Wapello,
9 Jefferson, Henry, Des Moines, Appanoose, Davis, Van Buren
10 and Lee.
11 2 . The second district shall consist of the counties of
12 WiRmeshiek7 Allamakee, Fayette, Clayton, Buchanan, Delaware,
13 Dubuque, Linn, Jones, Jackson, Cedar and Clinton.
14 3 . The third district shall consist of the counties of
15 Worth, Mitchell, Howard, Haxeeek7-8erre-Garde Winneshiek,
16 Floyd, Chickasaw, Wright7-Franklia7 Butler, Bremer, Hax►iltex7

16 from the same district provided in chapter 41, Code 1981 ,
17 that elected the senator or representative whose seat is
18 vacant. This section does not apply if a special election
19 is not required under section 69. 14 and is repealed January
20 1, 1983.
21 sec. 4. The membership of the senate and the house of
22 representatives in the seventieth and subsequent general
23 assemblies shall be determined as follows :
24 1 . Each representative district established by section
25 2 of this Act shall elect one representative for a term of
26 two years in 1982 and every subsequent even-numbered year.
27 2 . Each odd-numbered senatorial district established by
28 section 41 .2, which the general assembly adopts by reference,
29 and section 2 of this Act shall elect a senator in 1982 for
30 a four-year term commencing in January, 1983 . If an incumbent
31 senator who was elected to a four-year term which commenced
32 in January, 1981, or was subsequently elected to fill a vacancy
33 in such a term, is residing in an odd-numbered senatorial
34 district on April 2, 1982, that senator' s term of office shall
35 be terminated on January 1, 1983 .

1 3 . Each even-numbered senatorial district established
2 by section 41 .2, which the general assembly adopts by
3 reference, and section 2 of this Act shall elect a senator
4 in 1984 for a four-year term commencing in January, 1985 .
5 a. If one and only one incumbent state senator is residing
6 in an even-numbered senatorial district on April 2, 1982,
7 and that senator was elected to a four-year term which com-
8 menced in January, 1981 or was subsequently elected to fill
9 a vacancy in such a term, the senator shall represent the
10 district in the senate for the Seventieth General Assembly.
11 b. Each even-numbered senatorial district to which para-
12 graph a of this subsection is not applicable shall elect a
13 senator in 1982 for a two-year term commencing in January,
14 1983 .
15 Sec. 5 . For purposes of this Act, each reference to a
16 specific city or township means the city or township as its
17 bour,odiies -xisted on April 1, 1980, the official date of
18 the 1980 United States decennial census .
19 Sec. 6. This Act, being deemed of immediate importance,
20 takes effect from and after its publication in
21 , a newspaper published in
22 Iowa, and in , a newspaper published in
23 Iowa.
24 EXPLANATION
25 This bill provides for congressional and legislative
26 redistricting for the state effective during the 1982 general
27 election.
