SUBJECT: Rezoning Request
The Hyland Avenue Neighborhood Association requested that their neighborhood
be rezoned from R-2 (Low-Density Residential) ,to R1-6 (Low-Density Residential)
BACKGROUND: This area has been zoned R-2 since 1965 when the former zoning
ordinance went into effect.
There are a total of 26 residential structures of which 24 are single-family
(92%) and two are two-family (8%) . Of the 26 property owners in the area,
22 property owners (85%) have signed the petition requesting the rezoning.
The Land Use Policy Plan designates the area for low-density residential
development, but in this case the LUPP provides a minimum of guidance as far
as how this neighborhood should be zoned. Although the LUPP designates the
area for low-density residential, it gives no indication whether that low i
density should be R1-10, R1-6, or R-2. Some of the lots in the area do exceed
10,000 square feet, but it is preferable to use R1-6 zoning so as to result in
the fewest nonconforming, lots and to allow a larger number of lots to be created
if some of the larger lots are to be sudivided some time in the future.
The Planning and Zoning Commission recommended that this area be rezoned from
R-2 to R1-6.
ALTERNATIVES: The only alternatives available are to rezone the area as
requested or deny the request.
MANAGER'S RECOMMENDED ACTION: The City Manager recommends that this rezoning
from R-2 to R1-6 be approved and that a public hearing be set for November 10, 1981.
