Mrs. Manatt stated that she did not find the internally lit sign objectional. She noted that this is a commercial establishment that is already constructed and it would be defeatist to "throw rocks in the path of its success. " 140TION: (Sargent/lianatt) Move we approved the internally lit sign as proposed for the east side of the building. Motion carried unanimously. MOTION: (Sargent/Manatt) Move we approved an internally lit sign on the west side of the building as indicated in the drawings. 4 in favor (Sargent, Manatt, Sherkow, Whetstone) , l opposed (Hoffman) -------------------------------------------------------------------------------- Z-81-12 HYLAND AVENUE REZONING REQUEST Mr. Brennan reviewed this request to rezone 10 acres bounded by Ontario on the north, Hyland on the east, Ross Road on the south and Iowa Avenue on the west from R-2 to R1-6. He reported that there are 26 residential structures and 24 of them or 92% are single-family dwellings. The area is predominantly single family in character. The Land Use Policy Plan designates this area for low- density residential development but gives no indication as to whether the area should be zoned R-2 or R1-6. Of the 26 properties, the owners of 22 have signed the petition; that is 85% of the property owners in the area. Based on the existing situation with regard to the number of single-family structures in the area and the area's basic character, staff recommended approval of this request. At this point Mrs. Manatt asked about the widening of Hyland Avenue and which side would be widened. Mr. Brennan was not sure, but indicated that probably both sides would be. Speaking in Favor: Nancy Meeden, 1207 North Hyland Jim Prescott, 2810 Ross Road The following comments were made: 1. The widening of Hyland Avenue has been taken out of the City's Five Year CIP. 2. Residents have been discussing the rezoning for approximately 12 years. 3. When Ontario is widened, this should take pressure off of Hyland Avenue. 4. The majority of the residents want the area downzoned. 5. Large lots typify this area and in time these lots could be used for high- density development. 6. The area contains some older, distinguished homes. Planning & Zoning Commission 5 October 7 1981 7. Property values would depreciate if duplexes develop in the area. 8. There is vulnerability to the development of duplexes because there are a number of elderly homeowners living there. 9. Prior to 1980, R-2 was the only zoning designation allowed for lots less than 10,000 square feet. Speaking; in Opposition: There was no one present who spoke in opposition to this request. Commission Comments: Ms. Whetstone was in favor of the rezoning, but did not feel that residents of the area were facing up to potential changes as a result of the completion of the 13th Street extension. Mrs. Manatt agreed. Mr. Sargent indicated that philosophically he was opposed to the practice of downzoning, but felt this request was an exception. At this point Mr. Sherkow stated that it was important for the City Council to know the Commission is not considering downzoning in a vacuum, but as part of the overall process of looking at the Land Use Policy Plan. They do not consider these downzonings and the updating of the LUPP as two separate and independent processes, but as parallel processes using the same philosophy and the same concepts. Therefore, the Commission is not out of step or jumping the gun as may have been interpreted on other occasions. Mrs. Hoffman indicated she had asked a member of the City Council why all these rezonings were being referred to the Commission in a piecemeal manner. The answer was that the Council believed the Commission would never designate any of the areas in the city R1-6, therefore City Council referral was necessary. A joint meeting is scheduled for October 20th prior to the City Council meeting at which time the Council and the Commission can reach some understanding on downzoning requests. MOTION: (Manatt/Whetstone) Move we accept the staff recommendation to rezone from R-2 to R1-6 the 10 acres bounded on the north by Ontario, on the east by Hyland, on the south by Ross Road, and on the west by Iowa Avenue. Motion carried unanimously. --------------------------------------------------------------------------- Z-81-13 - REQUEST TO REZONE FROM R-2 TO R1-6 THE AREA WHICH INCLUDES THE LOTS FRONTING ON APLIN ROAD, WEST OF BEEDLE DRIVE; JEFFREY LANE; HARRIS AVENUE; WELLONS CIRCLE; AND WELLONS DRIVE EXCEPT THE FOUR LOTS AT THE NORTH OF WELLONS DRIVE Mr. Brennan presented this request to the Commission stating that the request included 12 and one-half acres within the area listed above. There are 40 residentila structures in the area; thirty-seven are single-family and three are duplexes. Additionally, there are 10 vacant lots along the south side of Harris Avenue. Owners of 22 of the lots in the area had signed the petition requesting rezoning and all of these signers are owners of single- family dwellings. The Land Use Policy Plan designates the area for low-
