Verbatim Transcript of a portion of the September 15, 1981 Council Meeting
relating to the referral of "down-zoning" request to the Planning and Zoning
Commission:

Charles Hammer My reason for bringing 8(b) (Petition requesting rezoning
from R-2 to R1-6 of block bordered by Hyland Avenue, Iowa
Street, Ontario Street, and Ross Road, and properties on
south side of Ross Road) aside was from a recognition of
reading the minutes of the Planning and Zoning Commission
that there are more than one neighborhood coming in for
down-zoning from R-2 to R1-6. It was my impression
originally when we adopted the R1-6 zoning regulation
that the Planning and Zoning Commission was going to go,
as part of their general Land Use Plan, throughout the
older neighborhoods and see which neighborhoods were
appropriate to rezone from R-2 to R1-6. I hate to see
this thing being tackled piece-meal and I would just as
soon see the Planning and Zoning Commission take on the
broader question, especially with respect to that particular
area and that is to look at the entire area and not just
the R-2 to Rl-6 for that particular section of the community.
Other than that I have no objection to what is being said.
John Parks In addition, this states P,-2 to R-1 . Do they mean R1-6
on here?
Charles Hammer It says RI-6.
John Parks It says R-1 here.
Charles Hammer 8(b) says R1-6.
John Parks The petition says R-1 .
Charles Hammer Well , I'm not certain. For that particular area it could
probably go to R-1 as well as R1-6 because there are large
lots. I just don't have the detailed information as to
which is what. That original area out there was platted
for single-family homes. .primarily single-family homes. .
and it was R-2 simply because of the lot size requirement.
Georgene Shank Charlie, I would support your recommendation to P & Z that
they look at all these areas. I think we have to pass this
petition on though, because I believe they came in and paid
their fee.
Charles Hammer Oh, I agree we have to pass it on. I just want it to be
passed on with the minutes of this meeting showing that the
Council did discuss that and wished they would look at them
all . It is the only reason I brought it aside.
Mary Atherly I think we are going to see probably a real flood of these

Charles Hammer Well , they are all coming in at once and there are some
areas, for example the area that I live in and those west,
that do not have a neighborhood organization and I think
that if we are going to be considering those old R-2 areas
that are all primarily all . .as a matter of fact many of them
are all single-family dwellings. . .if we are going to talk
about reconsidering those areas and now utilize R1-6 then
we should do all of it and not just one or two at a time.
Georgene Shank Yeah. In fact where the land use plan comes in they really
should tie the zoning to it. It is silly to have two things
floating out there.
Larry Curtis It seems to me we went through quite a detailed discussion
about this particular thing. . .
Charles Hammer At that time[
Lary Curtis zoning discussion re. the new ordinance on zoning and I think
it might be appropriate to review what was discussed at that
point in time in terms of philosophy that was incorporated
in going to the R1-6 zone and if I remember right, we very
definitely extablished R1-6 not as something to encourage
a change from R-2 to R1-6 but merely as a means in which we
saw the future in terms of R-1 zoning being in terms of that
size of residential property. I think that whole issue is
going to have to be resolved when we have the first one
before us in terms of what was the intent of that particular
ordinance change.
Charles Hammer Well , I move that this be passed on to the Planning and Zoning
Commission with the comments that the Council Members have
made.
