Properties affected by these requests include 1102 Kellogg Avenue, 1012 Duff Avenue, 1018 Duff Avenue, and 1102 Duff Avenue. The Planning & Zoning Commission, after reviewing these requests, decided to table action and moved that the property owners requesting said rezoning be notified of the Commission's intention of recommending in favor of the rezonings; and the Commission further moved that the owners of property located at 1108 Duff Avenue, 112 E. llth Street, and Block 107 west of the hospital; namely, lots 10, 9, 7, 6, 2, 5, and 4, be notified of the Commission's intention to initiate rezoning of said property from R-2 to H-M. Pursuant to notification of affected property owners as indicated above, the Planning & Zoning Commission met on March 4, 1981, during a regular session to reconsider the tabled requests for rezoning and to initiate other rezonings. Action taken by the Planning & Zoning Commission is as per a series of motions indicated below. RECOMMENDED ACTION: MOTION: (Sargent/Sherkow) Move to rezone property located at 1102 Kellogg from R-2 to H-M Motion carried unanimously. MOTION: (Sargent/Sherkow) Move to rezone property located at 1102 Duff from R-2 to H-M. Motion carried unanimously. MOTION: (Manatt/Hoffman) Move to rezone property located at 1012 Duff from R-2 to H-M. Motion carried unanimously. MOTION: (Sherkow/Sargent) Move to rezone property located at MIS Duff from R-2 to H-M. Motion carried unanimously. MOTION: (Sherkow/Whetstone) Recommend that 219 llth St. , 1108 Kellogg, 1122 Kellogg, and the properties described in the agenda item #6, in other words, lots 5, 6, 9, 10, and 12, Block 5, Duff's Addition, and 221 llth St.--Move we recommend those for rezoning change from R-2 to H-M. Motion carried unanimously. MOTION: (Sherkow/Manatt) Move that we recommend to the City Council a rezoning change at 112 E. llth St. from R-2 to H-M. Motion carried unanimously. MOTION: (Sargent/Whetstone) Move we recommend that the property located at 1108 Duff be rezoned to H-M. Motion carried unanimously. All of these motions are translated to mean that the following properties are recommended for rezoning as described by legal description. Z-81-1 - 1102 Kellogg Avenue--W. 90' of Lot 7, Block 5, Duff's Addition Z-81-2 - 1102 Duff Avenue--Lot 11, Paxton's Subdivision of Kingsbury's 3rd Addition Z-81-3 - 1012 Duff Avenue--Lot 7 and the S. 28' of Lot 6, Paxton's Subdivision of Kingsbury's 3rd Addition. Z-81-4 - 1018 Duff Avenue--W. 126' of Lot 5, W. 126' of Lot 6, and W. 126' of vacated alley, Paxton's Subdivision of Kingsbury's 3rd Addition. 1. 1108 Duff Avenue--Lot 2, Paxton's Subdivision of Kingsbury's 3rd Addition. 2. 112 East llth Street--E. 54' of Lot 5, E. 54' of Lot 6, and E. 54' of vacated alley Paxton's Subdivision of Kingsbury's 3rd Addition. 3. The S. 30' of Lot 5, Lot 6, the E. 90' of Lot 7 and all of Lots 8 - 12, Block 5, Duff's Addition. (This includes the properties owned by the Hospital as well as privately owned properties at 219 llth Street, 1108 Kellogg and 1122 Kellogg.) Properties being requested for rezoning are shown on the attached map with reference Z-81-1 through Z-81-4. And properties being initiated for rezoning as recommended by the Commission are illustrated on the attached map by reference numbers 1, 2, and 3. As can be seen by looking at the map, all properties recommended for rezoning are within the limits of the Hospital-Medical zone as prescribed in the Land Use Policy Plan. Please find attached copies of staff reports prepared by the Community Development Department only with reference to the four requested rezonings. APPROVAL OF MINUTES: The minutes of the February 18, 1981, meeting were approved on a motion by Sherkow, seconded by Manatt. Motion carried unanimously. RE'ZON I NGS r Mr. Kahler explained that at the February 4 Planning and Zoning Commission meeting the rezoning requests to be discussed had been tabled. MOTION: (Sherkow/Whetstone) Move we bring the motions back in order and vote on them one at a time. Motion carried unanimously. I . Z-81-1 To rezone property located at 1102 Kellogg from R-2 to H-M. There were no comments from the floor either for or against this rezoning. MOTION: (Sargent/Sherkow) Move it be approved. Motion carried unanimously. 2. Z-81-2 To rezone property located at 1102 Duff from R-2 to H-M. Charles Lounsberry, 1108 Duff,stated that he was for this rezoning and felt that anyone who is interested in having their property rezoned should be allowed to do so. He addressed the problems in his area because of spot zoning and stated that his property was valueless now as an H-M property because it can only be sold as one lot and not in combination with other lots in the vicinity. He added that his property is also valueless as residential property. Mr.. Lounsberry felt that the Commission has it's mind made up before the public meetings. He stated that lie did not care to have his property rezoned to H-M. MOTION: (Sargent/Sherkow) Move we approve it. Motion carried unanimously. i - + Planning & Zoning Colossion 2 March 4, 1981 3. Z-81-3 To rezone property located at 1012 Duff Avenue from R-2 to H-M. There was no one present who spoke either for or against the rezoning. MOTION: (Manatt/Hoffman) Move the rezoning. Motion carried unanimously. 4. Z-81-4 To rezone property located at 1018 Duff Avenue from R-2 to ii-M. There was no one present who spoke either for or against the rezoning. MOTION: (Sherkow/Sargent) Move the adoption. Motion carried unanimously. Mr. Kahler stated that the recommendation of the Planning and Zoning Commission was that the City Council look favorably upon these rezonings. He added that the Commission is a recommending body and that the City Council will make the final decision. Mr. Kahler then read the final motion brought hack to the floor. It was as follows: That the affected property owners and surrounding property owners within the limits set in the Code be notified of the intention of the Commission to change zoning from R-2 to H-M for the four properties tabled at tonight's meeting; namely, 1102 Kellogg, 1002 Duff, 1012 Duff, and 1018 Duff. The properties in addition to the one tabled that we would initiate rezoning on would be 1108 Duff, 112 L. llth Street , and Block 107 west of the hospital--namely, lots 10, 9, 7, 6, 2, 5, 4. There was a difference between the description of the lots to be rezoned on the agenda and those listed in the motion. Mr. Brennan explained that the difference was due to the fact that the properties were referred to by their legal description on the agenda instead of corresponding to the lot numbers on the Land Use Data File. He added that when these rezonings go to the City Council they must be referred to by their legal descriptions. Mr. Brennan then translated the properties as they were referred to c;n the agenda into the properties as listed in the motion as follows: Parcel #4 - lots 5 and 6 on agenda; parcel #5 - lots 9 and 10 on agenda; parcel 2 - lot 12 on agenda; parcel 7 - 221 llth Street on agenda; parcel #10 - 1122 Kellogg on agenda; parcel #9 - 1108 Kellogg on agenda; and parcel #6- 219 llth Street on agenda. MOTION: (Sherkow/Whetstone) Recommend that 219, llth Street, 1108 Kellogg, 1122 Kellogg and the properties described in the agenda item #6, in other words, lots 5, 6, 9, 10, and 12, Block 5, Duff's Addition, and 221 llth Street-- Move we recommend those for rezoning change from R-2 to H-M. There was no one present who spoke either for or against this motion. Motion carried unanimously. Mrs. Manatt stressed the importance of these properties being presented to the City Council as a package. Planning & Zoning Co*sion 3 March 4, 1981 The Commission then considered the rezoning from R-2 to H-M of the properties located at 112 E. llth Street and 1108 Duff. Mr. Kahler asked if any one present wanted to address these two rezoning. Charles Lounsberry, 1108 Duff, expressed his desire that his property remain R-2 since it has no value as H-M. Mr. Sargent stated that he would not be gaining anything by leaving his property R-2 and that rezoning it to II-M might be beneficial. Mr. Lounsberry noted that he wants to leave it R-2 so that the mistakes of the Planning Commission could be seen by the public. There was no one present who spoke either for or against the rezoning of property located at 112 E. llth Street. MOTION: (Sherkow/Manatt) Move that we r.�commend to the City Council a rezoning change at 112 E. llth Street from R-2 to H-M. Motion carried unanimously. Zoning History The property has been zoned R-2 since 1965. Public Utilities Water: 4" line in Duff Ave. , 4" line in E. llth Street Sanitary Sewer: 8" line in Duff Ave. Storm Sewer: Surface drainage to inlets at Duff and 12th Street. Other: • 2 0 Z-81-4 Vehicular Access Access is available from Duff Avenue and from E. llth Street. Physical Characteristics Vegetation: Typical of urbanized areas. Terrain: Relatively flat Drainage: Drainage is toward the north and east. Soils: N/A Flooding: Not subject to flooding. ANALYSIS: 1. The Land Use Policy Plan designates this property as being suitable for development of an H-M use. At present there are no H-M uses immediately adjacent to the property, although there is a medical clinic directly across Duff Avenue and a residential structure is being remodeled for a medical facility. 2. The property owner has no intentions at this time to construct a medical facility. The property owner does not reside at the property and it is anti- cipated that the owner will eventually sell the property for medical purposes.
