HomeMy WebLinkAboutA002 - objection to rezoning and proceedings City of Ames TIP M E M O R A N D U M T0 : Mayor Goodland and City Council Members FROM: Gina Bicknese, City Clerk 6, (3, DATE : October 21, 1981 SUBJECT: Rezoning of 1108 Duff Avenue - Charles Lounsberry At the October 20, 1981 Council meeting, Charles Lounsberry, 1108 Duff, appeared in connection with the matter of rezoning properties from R-2 to H-M in the vicinity of Mary Greeley Hospital , including his property at 1108 Duff. Mr. Lounsberry expressed his objection to the rezoning of his property. He believed that his property and 1102 Duff should have been rezoned to H-M along with 111 E. llth Street to afford the possibility of future development of one large medical facility on the three lots. However, the owner of 111 E. llth Street had re- quested the rezoning to allow the conversion of the property to a medical use. Mr. Lounsberry is of the opinion that such rezoning and conversion has rendered his property valueless since the potential of combining the three lots is no longer possible. Mr. Lounsberry also stated that he had not been provided with notice of Council 's hearing when considering the request to rezone 111 E. llth Street. The Council then requested a chronological listing of the events in the matter. 1. Requests to rezone 111 E. llth St. (Eagan) and 115 E. llth 10/22/80 St. (Christenson) from R-2 to H-M were filed with the City Clerk. 2. Department of Community Development wrote to Mr. Lounsberry 10/23/80 informing him of the rezoning request and asking if he would be interested in having his property rezoned. 3. Department of Community Development mailed copies of notices 10/27/80 of the November 5, 1980 Planning and Zoning Commission meeting to consider the two requests. Mailing list included Mr. Lounsberry. 4. Planning and Zoning Commission held the hearing on the two 11/5/80 requests. Mr. Lounsberry expressed his opposition to the requests with the belief that the three properties should be zoned to accommodate one large clinic rather than allowing the conversion of the dwelling at 111 E. llth St. to a medical use. The Planning and Zoning Commission approved the rezoning of 111 E. llth St. and denied the rezoning of 115 E. llth St. Page 2 10/21/81 ' 5. Council considered the recommendations of the Planning and 11/18/80 Zoning Commission and set December 16, 1980 as the date of hearing on both rezonings. 6. City Clerk' s office mailed notices of the December 16 hearing. 11/24/80 Mailing lists of both rezonings included Mr. Lounsberry. 7. Notice of the hearing was published in the paper. 11/26/80 8. Hearings were held by Council . Mr. Lounsberry did not appear . 12/16/80 Council passed the ordinance on first reading rezoning 111 E . llth St. and denied the rezoning of 115 E. llth St. 9. Request filed with City Clerk to rezone from R-2 to H-M 12/23/80 1102 Duff. 10. Request filed with City Clerk to rezone from R-2 to H-M 12/24/80 1102 Kellogg. 11. Ordinance passed on second reading to rezone 111 E. llth St. 1/6/81 12. Requests filed with City Clerk to rezone from R-2 to H-M 1/12/81 1012 and 1018 Duff. 13. Ordinance 2768 adopted rezoning 111 E. llth St. 1/20/81 14. Department of Community Development mailed notices of the 1/28/81 Planning and Zoning Commission meeting February 4, 1981 on the four new requests for H-M zoning. Mailing list include Mr. Lounsberry. 15. Planning and Zoning Commission considered the requests . Mr. 2/4/81 Lounsberry did not appear. Commission stated their intenti n to recommend rezoning of the four properties plus the rezoning of 1108 and 1122 Kellogg ; 1108 Duff (Lounsberry) ; 219 llth. 112 E. llth. ; NW corner of llth and Douglas ; and property on th east side of Kellogg between llth and 12th. Commission tab ed all of the rezonings until their March 4, 1981 meeting and directed that all affected property owners and surrounding property owners be notified of the Commission' s intention t rezone all of the properties. 16. Department of Community Development mailed notices to all o2, 2/23/81 the affected and surrounding property owners, including Mr. Lounsberry, of the March 4 Commission meeting. 17. Planning and Zoning Commission reviewed all of the properti s. 3/4/81 Mr. Lounsberry expressed his opposition to the rezoning of his property at 1108 Duff feeling that it would have no val e as H-M since it could not be part of a large medical develo ment. Planning and Zoning Commission voted in favor of rezoning all of the properties , including 1108 Duff. 18. Council considered the Planning and Zoning Commission rec- 3/17/81 ommendation and voted to table the rezonings until the Com- mission presented the final report of the H-M area in the updated Land Use Policy Plan. Page 3 10/21/81 19. Council received notice from the Planning and Zoning Com- 9/22/81 mission that the review of the Land Use Policy Plan for the H-M area was complete and that the boundaries would not change. Commission urged Council to take action on the rezonings tabled March 17, 1981. Council removed the re- zonings from the table and set the hearing for October 20. 20. City Clerk's office mailed notices of the hearing. Mailing 10/l/81 list included Mr. Lounsberry. 21. Notice of the hearing was published in the paper. 10/2/81 22. Council held the hearing on the rezonings. Mr. Lounsberry 10/20/81 again expressed his opposition to the rezoning of his property and stated that he had not been given notice of when Council considered the rezoning of 111 E. llth St. Council requested a chronological listing of the events and passed the ordinance on first reading rezoning all of the properties. The attached materials document several of the events above listed. The numbers on .the materials correspond to the item number of the report. The Department of Community Development perceives this as an opportunity to rezone this entire area 1141 so as to conform with the Land Use Policy Plan. Mr. Brennan reviewed the staff report concerning this request for the Commission. He stated that this property Is in an area designated for. Hospital-Medical by the Land Use Policy Plan, that it is zoned R-2, that the existing structure will be remodelled to be compatible with adjacent residential structures. It was also noted that the lot is not contiguous to the other lots zoned H-M. Mr. Brennan stated that from a planning standpoint the staff feels that the two lots to the north and west should also be rezoned to H--M since those lots are also designated H-M in the Land Use Policy flan. Mr. Brennan informed the Commission that the owners were contacted and they were opposed to any rezoning at this time. Mr. Brennan proceeded to review the si.s:z of the lot and the structure to be built, the number of parking spaces that will l.c available and the location of the parking lot. He stated that development of' this property could lead to other small clinics developing on the other two properties and it is conceivable that at a future date all three properties could be developed for one clinic. Since the present structure at Ill E. llth Street will. be remodelled, the eventual combination with the other lots to create a new facility would not he impossible. Mr. Brennan stated that the Department recommends anproval of this request because the land is designated fl-M in the band Use Policy Plan, the applicant has proposed a use that is an approved vise in the H-M zone and is a use compatible with H-M uses, and the remodelled structure will maintain the residential character of surrounding residential structures. Mr. Brennan added that the staff feels it would be proper for the Commission to make a recommendation to rezone the other two properties to the north and west if the Commission feels that approach Is appropriate. Franklin Sherkow asked Mr. Brennan if` this request could he considered as spot zoning. Mr. Brennan stated that it could he considered spot zoning from the standpoint that it is not contiguous with the li-M zone and added that it would be more evident if the lots to the north and west would never be rezoned H-M. Mr. Sherkow was concerned that if the Commission was to approve the rezoning, they would be making a forgone conclusion that other properties in that area would follow some time in the future. Mr. Brennan stated that the staff was guided by the Land Use Policy Plan which designates these properties for li-M and made the point that the rezoning could conceivably slow down the development of those other lots. Mr. Kahler asked if the staff was doing* any long--range planning in terms of recommendations for H-M growth. Mr. Brennan stated that the staff has studied the area and has prepared a staff report in anticipation of review of the Land Use Policy Plan. That area around the hospital_ will continue to grow and there will be a need for additional H-M zoned property in the future. Mr. Brennan stated that consideration has been given to going farther east on 13th Street toward Carroll. Mr. Kahler asked what the staff envisioned that area would develop into and Mr. Brennan stated that more clinics would probably be built, but this is difficult to project. Mr. Zingg stated that it is unfortunate that: this request did not come up after the Commission had studied the Land Use Policy Plan more extensively. John E. Nutty, attorney at law, 807 Douglas, who represented Mr. Eagan, spoke in favor of the rezoning. He stated that he also represented Jacqueline Christenson. He gave the Commission a personal history of Mr. Eagan and explained Mr. Eagan's desire to have his own office. Mr. Nutty stated that 111 E. llth Street was an obvious place for a clinic. }le described other properties presently within the H-M zone that are available and explained why they would not be suitable for Mr. Eagan. He staged that: the owners to the north and west were contacted and they are resisting the rezoning, however, he does not see any objections to a small. professional house. Mr. Nutty explained that the Christenson's were willing to join in to make. Mr. Eagaii's property contiguous with the H-M district. He stated that the Clristenson's do not intend to move at this time. Mr. Eagan spoke in favor of the rezoning. iie' st.ate<1 his reason for purchasing this house at its location. lie gets :i lot of referrals from the hospital and at present his office is located in t-he haseitient of Riverside Mallor which makes it inconvenient for some patients to get there. Mr. Charles Lounsberry, 1108 Duff, spoke in opposition to the rezoning stating his objection to the house being converted into a clinic. He felt it would be a better use to rezone all three properties and build one large clinic. He was concerned that the value of his property would go down If three small clinics were built instead of one large one. Mary Terpstra, 223 6th Street, represented the Bandshell Neighborhood Association and stated her concern over the spread of the H-M zone. She concurs with the staff opinion to allow the rezoning, but wants more extensive planning before anything else is rezoned H-M. Mrs. Manatt concurred with the staff reconmiendation since it is designated in the Land Use Policy Plan and did not consider this request un- reasonable. Mr. Zingg stated that lie subscribed to tLe argument that the Land Use Policy Plan needs to be used as a guide both to deny requests and to approve requests and, thus, using the Land Use Policy flan as a guide he supports the staff recommendation. The Land Use Policy Plan designated that entire corner H-M, but it does not mean that it should liappen right now. Mr. Zingg stated that because of this designation serious consideration should be given to rezoning requests. Mr. Sherkow stated that he was concerned that the Commission might create a situation whereby an island of H-M 'zoned property could develop which would eventually force the houses at least on the subject block to be zoned 11-M whether the owners want it or not. He stated that the Commission is forwarning people in that area that after the Land Use Policy Plan update, there is an extremely good chance property will be designated li-M. Mr. Sherkow stated that it is important for the Commission in granting approval of the rezoning request at 111 E. llth Street to be cognizant of this eventual rezoning. t- 5 Mr. Zingg stated that this particular rezoning request falls within the present Land Use Policy Plan and it does not imply that the Commission will change the H-M line in that area, nor does it imply that the Commission will not. Mr. Sargent concurred with Mr. Sherkow's concern with regard to the .+r.r.� spread of the H-M zone and asked if rezoning of other properties could be considered at the meeting. Mr. Zingg stated that it was possible, but that he thought it would be important to review the Land Use Policy Plan and have discussions with interested persons before any other rezoning is considered. Mr. Sherkow stated that people in that area should be informed as to H-M designations. Mrs . Manatt stated that it is important: to wait on other rezon.i.ngs until after review of the Land Use Policy Plan. Mr. Zingg asked Mr. Sherkow if lie thought that rezoning should follow shortly after any designations for H-M zones in the Land Ilse Policy Plan. Mr. Sherkow stated that if the Commission is serious about the Land Use Policy Plan, then the most predictable way of stating publicly what policy is and where lines Are to be drawn is by including it in the Land Use Policy Plan and on the zoning map initially. MOTION: (Manatt/Kahler) Move that we accept the staff recommendation to approve the rezoning request irum R-2 to H-M. Motion carried unanimously. 3. A request by Jacqueline L. Sydnes Christenson to rezone from R-2 (low- density residential) to H-M (hospital-_m_edi.cal) _prc)pe_rty located at 115 E. llth Street. Mr. Brennan reviewed the rezoning request for the Commission. Ile stated ■+� that there were three important points that nc�edr.'d to be.. considered and thosr- were that there is a lack of definitive designaf:i.on in the Land Use Policy Plan and the Policy Plan does not provide the normal guidance from the standpoint of eventual use of the subject property, the stihject parcel_ is not included in the H-M zone, and the property ow,mer has no intention of developing the property at this time. Mr. Brennan stated that the st,rff: recommends that this request be denied because of the reasons stated above. He suggested that through the review process of the Land Use Policy Plan some decision might be made as to how far east the II-M zone should extend. Ms. Whetstone asked if a committee from the hospital was scheduled to have a discussion meeting with the Commission. Mr. Zingg stated that no arrange- ments have been made to have the Hospital Board ur its renr.esentatives meet with the Commission, however, he suggested that titi_ be put on an early agenda. Mrs. Manatt added that the Commission should he,-ir from all interested persons . Mr. Sherkow was concerned that there would be a year's waiting period if this rezoning request at 115 E. 11th Street: was turned down and the Commission reversed its decision about the rezoning to H-M. Mr. Brennan stated that the property owner would have to wait a year if their request is denied, but the Council or the Commission could initiate action. Iie added that this item could also be withdrawn by the applicant. mom John E. Nutty, attorney at law, 80/ Douglas, represented the Christenson's and spoke in favor of the rezoning. Mr. Nutty emphasized that the request for 6 y T 1 rezoning of the property at 115 E. llth Street was because this property backed up to the H-M zone and it would provide conformity. The Christenson's were trying to be helpful. Mr. Nutty requested that if this request is denied and if, after review of the Land Use Policy Plan it is decided that this property should be in the H-M district, the Commission should ask for the rezoning in the event the Christenson's get an offer on their property. Mr. Lounsberry repeated his concern with regard to the City of Ames allowing medical clinics in converted houses and stated that the City should strive for newer buildings and combine several medical offices in one larger building. Mary Terpstra repeated her concern for spot zoning and suggested that the Commission begin saying "no". She stated that the neighborhoods are looking to the Commission for direction. Mr. Sherkow suggested that the Commission members do not serve long enough to make any guarantees and agreed with Mrs. Terpstra that the Land Use Policy Plan should be something that a neighborhood could plan on. MOTION: (Kahler, Manatt) Move that we accept the Planning staff recommendation for the three reasons listed. There was discussion on this motion. Mr. Sherkow suggested to the Commission that this proposed change be tabled and that it be up to the property owners to come back within 12 months and initiate their own action rather than having the Council come to the Commission and ask for a change. Mr. Zingg stated that there was a 90-day period in the new zoning ordinance which requires the Commission to act either to approve or deny and if the Commission fails to act, then it goes to the Council with the Commission's blessing. Mrs. Manatt stated that if the request is denied, then after study of the Land Use Policy Plan the Commission would follow up on this request and not leave the owner hanging. Mr. Kahler suggested that the owners come back to the Conmlission fur a reconsideration. Mr. Zingg stated that if this motion is approved, then there needs to be some initiative from the Commission to initiate a rezoning. Mr. Sherkow was concerned about being more clear with the motion and Mr. Zingg stated that the Commission could provide the Council with a warning that this might come up again and the circumstances tinder which it might happen. Mrs. Hoffman stated that she was nut ready to vote in favor of the rezoning because it does not fall into the Land Use Policy Plan. Motion carried unanimously. COMMISSION COMMENTS: Mrs. Manatt asked if the Council. had received the memorandum regarding the agricultural land use and urban revitalization that they had requested. Mr. Zingg indicated that Don Dobson, representing Mary Greeley Hospital Board, would be at the meeting to address any questions that may arise relevant to the Hospital's plans in the vicinity of the rezonings which will be considered. APPROVAL OF AGENDA: The agenda was approved on a motion by Sherkow, seconded by Manatt. Motion carried unanimously. APPROVAL OF MINUTES: The following correction was made to the minutes of January 21, 1981: Page 3, Section 7, second paragraph, fourth line, change "the Interstate" to "Highway 30." The minutes as amended were approved on a motion by Hoffman, seconded by Kahler. (5 in favor, 1 abstention (Sherkow)) NEW BUSINESS: REZONING CASES Z-81-1, Z-81-2, Z-81-3, Z-81-4 MOTION: (Sherkow/Whetstone) That we discuss all four of these in the order as listed on the agenda but postpone a vote until the end of all four. Discussion: Mr. Sherkow stated that it was unusual to have an occasion where the Planning and Zoning Commission has two or more decisions which are so tightly grouped both geographically and from an issue standpoint. He suggested that all these be discussed before the Conunission comes to any decision since different neighborhood issues could surface with each rezoning request. Mr. Zingg stated that there may be a broader issue to discuss in this context and noted that the Commission had recently recommended a rezoning from R-2 to H-M of a property on 11th Street east of Duff Avenue and the City Council had proceeded with that rezoning. At that Council meeting the possibility of that request constituting spot zoning was brought up. Mr. Zingg advised the Commission that it may be fitting at this time to determine if there are other properties that should be rezoned. ll Motion carried unanimously. \r✓ 1. Z-81-1 Request to rezone property located at 1102 Kellogg Avenue from R-2 (Low Density Residential) to H-M (Hospital Medical) Dean Brennan gave the Commission an overview of this request. He stated that this property is designated for H-M development in the Land Use Policy Plan and the Planning & Zoning Commission 2 February 4 , 1981 property owner anticipates remodelling the structure on the site for medical fir• purposes. He added that the property is on a block that is designated for future expansion by the hospital. Mr. Brennan indicated that the owner had offered to sell the property to the hospital, but an agreement could not be reached so the owner has decided to go ahead with rezoning. He stated that the Community Development Department recommends that this request for H-M zoning be approved because the Land Use Policy Plan designates the property as being suitable for hospital-medical purposes and the property owner has indicated that it is his intention to use the property for H-M purposes and not just rezone the property for resale. Mr. Brennan indicated that an additional property to consider for rezoning is the property located south of llth Street at the corner of llth and Douglas which is presently used as a parking lot. Mrs. Manatt asked if the hospital owned lots 6, 7 and 9 as shown on the staff report map. Mr. Brennan stated that on that block the hospital owns all the properties except lots 6, 8, 9 and 10. Mr. Zingg indicated that in terms of present zoning, all of these properties were zoned R-2. Mr. Dobson addressed the Commission giving the Hospital Board's reaction to this rezoning. He stated that the Hospital Board takes no position on this rezoning either for or against and added that the hospital did have an opportunity to buy this property but was unable to reach an agreement with the property owner. He related a similar situation with the property on Lot 6. Mr. Dobson discussed the hospital's long-range plans and indicated that the Hospital hopes to acquire the two blocks bounded by Kellogg on the west, 12th on the north, loth on the south and Douglas on the east. They expect to extend the hospital tower west across Douglas in 10 to 15 years at which time they hope to build a ramp. Mr. Zingg asked about their interest in the block just south of the hospital and Mr. Dobson stated that the hospital has no interest in acquiring that block for development. Mr. Zingg questioned whether the hospital would have any problems if the Planning and Zoning Commission was to rezone all the property in block 107 of which the hospital owns some property. Mr. Zingg stated that if only Lot 8 was rezoned as requested, this would leave three almost isolated properties that are R-2 and one could question, in terms of planning, the wisdom of doing that. Mr. Dobson reiterated that the hospital's official position is that they are neither for or against. Mr. Zingg then asked Mr. Dobson about the other properties up for rezoning and Mr. Dobson stated that the hospital is neutral on those rezonings as well. There was no one present at the meeting who spoke either in favor of or in opposition to the rezoning. Mrs. Hoffman asked if the Commission would have to announce their intention to rezone those other properties which have not come forward at this time for rezoning. Mr. Brennan stated that the Commission needs to make a recommendation to the City Council. He added that the property owners could be informed that a recommendation has been made to the City Council and they could appear at the City Council meeting and state their opinions. Mr. Brennan indicated that initiating these rezonings of the other properties on that block would have no affect on the taxes of those properties. Mrs. Hoffman stated that she would rather tell those people what the Commission wanted to do before making a recommendation Planning & Zoning Commission 3 February 4, 1981 to Council. Mr. Sherkow asked if there would be any problem from the standpoint of time if these requests were tabled so that people who might be affected could be notified. Mr. Zingg read Section 29. 75 of the Zoning Ordinance which states that the Commission has 90 days or three consecutive monthly meetings from the time the rezoning proposals are referred by the Council to act upon them and return them to Council. 2. Z-81-2 Request to rezone property located at 1102 Duff Avenue from R-2 (Low Density Residential) to H-M (Hospital-Medical) . Mr. Brennan reviewed this request for the Commission stating that this property is designated for H-M development in the future. He stated that the Department recommends approval of this request and if approved, there will be one property remaining on Duff Avenue between E. 11th Street and E. 12th Street still zoned R-2. The Department suggests that the Commission initiate a rezoning for the property which is located immediately north of the subject property. Mr. Zingg noted that at another meeting the owners of the property to the north spoke in opposition to rezoning. There was no one present at the meeting who spoke either in favor or against the rezoning. 3. Z-81-3 Request to rezone property located at 1012 Duff Avenue from R-2 (Low Density Residential) to H-M (Hospital-Medical) Mr. Brennan reviewed this request for the Commission stating that the property is in an area designated for future H-M development in the Land Use Policy Plan. The owners have indicated that they would probably build an office building some time in the future. Colleen Gardner, owner of 1012 Duff, spoke in favor of the rezoning. She indicated that she has been contacted by some medical. people who are interested in a medical facility on that property but she does not have a timetable. She noted that a single-family dwelling would not be desirable at this location. Mrs. Hoffman recommended that when the office building is built it would be better land use to have a multi-level building; rather than another one-story facility. No one spoke in opposition of the rezoning. 4. Z-81-4 Request to rezone property located at 1018 Duff Avenue from R-2 (Low Density Residential) to H-M (Hospital-Medical) Mr. Brennan gave an overview of this request and stated that the property is in an area designated for future H-M development in the Land Use Policy Plan. He added that the owner has not indicated what lie plans for that property. No one spoke either in favor or in opposition to the rezoning;. Commission Discussion The Commission discussed these four rezonings and other properties that they should consider for rezoning from R-2 to H-14 in the vicinity of these requests. Mr. Zingg stated that the Commission should consider this area from the point of view of how to best , in an orderly fashion, determine what rezonings should be Planning & Zoning Commission 4 February 4, 1981 made and how to proceed to fill in Land Use Policy Plan designations. He noted that one concern already discussed was adequate notification to property NW owners. Ms. Whetstone asked about the condition of the buildings to the south of 1012 Duff and stated that there is no use in pressuring rezoning faster than is needed. Mrs. Manatt stated her preference for considering these rezonings in a group and her concern about having many one-story medical centers which, in her opinion, is not good use of the land. Mr. Sherkow suggested that the Commission table these requests and consider them again including any other properties that are considered for rezoning. The property owners could be notified that rezoning requests on their part would be favorably considered. He added that adjacent property owners could be notified that these additional rezonings would constitute the limit of the expansion of the H-M district. In other words, the Commission would be approving the present rezoning requests and initiating several others and then setting some very firm limits beyond which there would be no more H-M rezonings. Mr. Sherkow suggested initiating rezoning of the property north of 1102 Duff, those directly east of 1018 Duff, and the entire block, shown as Block 107,on the land use map west of the hospital. Mr. Zingg reviewed the rezoning procedure by the City Council. Colleen Gardner stated that if these four requests are lumped with others, there might be contro- versy, but considering the requests separately might not cause any problems. Mr. Sherkow noted that the Commission is in a controversial stage at present because of the Council's concern over spot zoning. With these four rezoning requests there is an opportunity to go to the City Council with those requests plus others. Mr. Zingg stated that he preferred to view this from what makes sense from a planning point of view. He added that this area is a transition area and the Commission has a responsibility to accomplish these transitions in an orderly fashion. He believed that presenting this as a package is an orderly approach. Mr. Sherkow stated that, going along the lines of predictability and longevity of policy, he would like to make it clear to property owners inside the area and on the border of this area what the Commission' s long--term intentions are. Planning & Zoning Commission 5 February 4, 1981 MOTION: (Sherkow, Manatt) That the affected property owners and surrounding property owners within the .limits set in the Code be notified of the intention of the Commission to change zoning from R-2 to H-M for the four properties tabled at tonight's meeting; namely, 1102 Kellogg, 1102 Duff, 1012 Duff, and 1018 Duff. The properties in addition to the ones tabled that we would initiate rezoning on would be 1108 Duff, 112 E. llth Street and Block 107 west of the hospital--namely, lots 10, 9, 7, b, 2, 5, 4. Motion carried unanimously. DISCUSSION OF AREA 1 Mr. Zingg asked for comments from Commission members. Mrs. Manatt noted that one of the things that the residents of. the Teagarden area are concerned about is parkland and she asked if the items in the capital improvements plan will be completed because, if they are, they would take care of the concerns voiced by the residents. Mrs. Hoffman asked about the results of the matrix that the people filled out during the meeting and Mr. Brennan stated that the only things that came out of it were the problems with the airport , mass transportation, existing water Pollution control plant and O'Neil Park. Mr. Zingg stated that he would draft a letter to go to the Parks and Recreation Department concerning O'Neil Park. Mr. Kahler asked if the Commission was getting the kind of information that they need to look at zoning and land use. Mr. Zingg stated that opinions made by Commission members from the public meetings will assist in updating the Land Use Policy Plan. He noted that Commission members should also keep in mind areas which could be designated for urban revitalization as this process of public meetings is continued. Mr. Zingg stated that two of the sites studied as possible locations for the new Ames city hall; specifically the block just south of the Chicago & Northwestern Railroad tracks and east of Kellogg Avenue and the northwest corner of Lincoln Way and Kellogg Avenue, are -in Area 1. He added that if either of these were chosen this would be a positive step towards redevelopment in that area. He referred to the St. Cecilia area and stated that he saw no compelling reason to do anything in terms of land use that would threaten those neighborhoods. Mr. Zingg noted that the Commission may have to make some decision with regard to the area around the airport; in other words, should the land use discourage further residential development at the end of the runways. In terms of the flood plain, Mr. Zingg stated that the Commission is obligated not to allow building in that area. He added that he supports improvements and redevelopment in the area entering the City of Ames. Mr. Kahler addressed the need for a grocery store in that area and suggested the possibility of some commercial zoning to permit that kind of development . Ms. Whetstone indicated her support of these public meetings. She addressed the traffic situation on South Duff and stated that something should be clone about it since there are some real danger spots there. Mr. Sherkow explained how speed limits are set and stated that on entrances to a City, speed limits are posted that are normally lower than what someone would expect. He explained that if speed limits are lowered some enforcement has to be dedicated to that area and that involves some expense. He addressed the problems in his area because of spot zoning and stated that his property was valueless now as an H-M property because it can only be sold as one lot and not in combination with other lots in the vicinity. He added that his property is also valueless as residential property. Mr. Lounsberry felt that the Commission has it's mind made up before the public meetings. Mr. Kahler stated that the recommendation of the Planning and Zoning Commission was that the City Council look favorably upon these rezonings. He added that the Commission is a recommending body and that the City Council will make the final decision. Mr. Kahler then read the final motion brought back to the floor. It was as follows: That the affected property owners and surrounding property owners within the limits set in the Code be notified of the intention of the Commission to change zoning from R-2 to H-M for the four properties tabled at tonight's meeting; namely, 1102 Kellogg, 1002 Duff, 1012 Duff, and 1018 Duff. There was a difference between the description of the lots to be rezoned on the agenda and those listed in the motion. Mr. Brennan explained that the difference was due to the fact that the properties were referred to by their legal description on the agenda instead of corresponding to the lot numbers on the Land Use Data File. He added that when these rezonings go to the City Council they must be referred to by their legal descriptions. Mr. Brennan then translated the properties as they were referred to on the agenda into the properties as listed in the motion as follows: Parcel #4 - lots 5 and 6 on agenda; parcel #5 - lots 9 and 10 on agenda; parcel 2 - lot 12 on agenda; parcel 7 - 221 llth Street on agenda; parcel #10 - 1122 Kellogg on agenda; parcel #9 - 1108 Kellogg on agenda; and parcel 1#6- 219 llth Street on agenda. MOTION: (Sherkow/Whetstone) Recommend that 219. llth Street , 1108 Kellogg, 1122 Kellogg and the properties .described in the agenda item #6, in other words, lots 5, 6 , 9, 10, and 12, Block 5, Duff's Addition, and 221 llth Street-- Move we recommend those for rezoning change from R-2 to H-M. There was no one present who spoke either for or against this motion. Motion carried unanimously. Mrs. Manatt stressed the importance of these properties being presented to the City Council as a package. Planning & Zoning Commission 3 March 4, 1981 The Commission then considered the rezoning from R-2 to H-M of the properties located at 112 E. llth Street and 1108 Duff. Mr. Kahler asked if any one present wanted to address these two rezoning. Charles Lounsberry, 1108 Duff, expressed his desire that his property remain R-2 since it has no value as H-M. Mr. Sargent stated that he would not be gaining anything by leaving his property R-2 and that rezoning it to II-M might be beneficial. Mr. Lounsberry noted that he wants to leave it R-2 so that the mistakes of the Planning Commission could be seen by the public. There was no one present who spoke either for or against the rezoning of property located at 112 E. llth Street. MOTION: (Sherkow/Manatt) Move that we recommend to the City Council a rezoning change at 112 E. ll.th Street from R-2 to H-M. Motion carried unanimously. MOTION: (Sargent/Whetstone) Move we recommend that the property located at 1108 Duff be rezoned to H-M. Motion carried unanimously. DISCUSSION WITH AMES HOMEBUILDERS ASSOCIATION AND AMES BOARD OF REALTORS Mr. Kahler opened this discussion by explaining that the Commission is asking for information from groups throughout the City before it begins revising the present Land Use Policy Plan. Norman Rudi, 2012 Pinehurst Drive, stated that one of his concerns related to the road system in Ames and the need for another road, possibly around Franklin Avenue or Elwood Drive, going north and south since at present Grand Avenue and North Dakota/South Dakota are the only two nortli-south thoroughfares. Ile added that 24th Street and Top-O-Hollow Road should be extended as soon as possible because of the need for a good road system around Ames. Mr. Rudi stated that many people have been encouraging the development of the ravines around Ames to save farmland , but there are no ravines left that are undeveloped. He noted that growth in Ames will go north and west and stated that he supported extending 20th Street to tie into 24th Street. He stated that the City of Ames will eventually need a limited access highway in the north part of the City and Bloomington Road was originally planned for this purpose. Mr. Sherkow brought up the problem of paying for road improvements and stated that he thinks there is a severe problem financing new road and street facilities. He does not foresee the Legislature increasing the road use tax funds to allow for new roads. There is a need to maintain and improve the present system. Mr. Sherkow stated that one of the things he will be looking at is what could be done in the community to direct some of the growth to the land that is already being used for development. He asked the developers for their input on what the Commission could do in terms of suggesting tax breaks or freezes to encourage redevelopment , whether downtown or someplace else, and the infrastructure that is already in place would be used. He asked how the community could reuse land that has already been used. Ed Hendricks, 1920 Paulson Drive, addressed Mr. Sherkow's question and suggested that the Commission quit downzoning and begin upzoni.ng to make the interior property more valuable so that developers would utilize it.
