Anderson STATUS OF APPLICANT: Contract Buyer REQUESTED ACTION: Rezone from A-1 (agricultural) to R-5 (Mobile Home) and G-C (General Commercial) PURPOSED FOR REQUEST (as stated by Applicant) : "To develop this property into a well designed mobile home park to meet the housing demand for affordable mobile home living. The commercial uses would be primarily complimentary to the proposed mobile home park and the residents in the immediate area." LOCATION: South side of South 16th Street immediately east of Old Orchard Mobile Home Park. SIZE: Approximately 21.5 acres (R-5 20.513 acres, GC 1.033 acres) EXISTING LAND USE: Presently being used for agricultural purposes. SURROUNDING LAND USE & ZONING: North: Agricultural; A-1 South: Agricultural; G-I East: Agricultural, residential; G-C West: Mobile Home Park; A-1 (Special Use Permit for a Mobile Home Park) FI14DINGS: Land Use Policy Plan The Land Use Policy Plan designates the area as being suitable for commercial development. l Public Utilities Water -- 12" line in South 16th Street Sanitary Sewer -- 8" line in South 16th Street, 18" line located adjacent to the stream on property Storm Sewer -- Natural drainage areas Vehicular Access Adequate vehicular access is provided from South 16th Street. The street is not paved adjacent to this property but the property owner is intending to pave a portion of the street. Physical Characteristics Vegetation -- Vegetation on site is that which is generally found in agricultural areas. There are also a number of trees adjacent to the small drainage way that crosses the property. Terrain -- Gently sloping Drainage Drainage is generally to the northwest Soils -- 65% of the subject parcel is non-prime ag land Flooding -- The only portions of the site susceptible to flooding would be the area adjacent to the small stream that traverses the site ANALYSIS: 1. The Land Use Policy Plan does not designate this area as suitable for low density residential development but for commercial development. It would seem the Commission must decide whether the LUPP should be amended in this particular situation and whether the community would be better served by having residential development at this site. It should be noted that the area to the east is being used for residential purposes although it is zoned G-C and is designated for commercial purposes in the LUPP. 2. The applicant has submitted a preliminary plan for a mobile home park but is only requesting rezoning at this time. Once the zoning is approved, the applicant will submit the formal planning documents for approval of a plan based on the yet to be adopted mobile home ordinance. This is a deviation from the current R-5 section of the Zoning Ordinance which requires a comprehensive plan accompany the rezoning request. The Department feels that a degree of flexibility should be allowed since the R-5 requirements are in the process of being changed and the two step approach, rezoning then submittal of plan, allows for a greater degree of flexibility on the part of the mobile home park developer. 3. The applicant has requested that a portion of the property be zoned G-C (General Commercial) . This area will serve as a convenience center for the mobile home park and will include an office, laundry, and small convenience grocery store. Because of its location, it is surrounded on three sides by residential development and the Department would prefer the area be zoned P-C (Planned Commercial) . The applicant has indicated that he is not opposed to having the area set aside for commercial development being zoned P-C. The revised ordinance provides for accessory uses in mobile home parks in- cluding some commercial uses such as a laundry and convenience store. The use must be used exclusively by the residents of the mobile home park, as much as practical. In this case, the intention of the developer is to provide a commercial area that will serve a broader population than just the residents of the mobile home park. • i In addition, the applicant has indicated that there would be on-site sales of mobile homes until such time as all mobile home spaces are occupied. The mobile homes sales area will not be a separate sales area, but rather a portion of the mobile home park set aside as a "model 'home" area. 4. Property to the west is presently being used for a mobile home park, but is zoned A-1. This is a permitted use because of a Special Use Permit which was granted by the Zoning Board of Adjustment in 1969. It is suggested that this property be rezoned R-5 at the time that revisions are made in the zoning map to bring it into conformance with the land use designations in the LUPP. 5. The mobile home ordinance has not been approved by City Council and was tabled for further staff input when it was before the Council on October 21, 1980. The ordinance has once again been returned to City Council and it will be on their August 13, 1981, agenda. It is anticipated that the ordinance will be adopted prior to submittal of the planning documents by the applicant. 6. Although the property is in close proximity to the Ames Municipal Airport, it does not lie in the flight path of either runway. Contact with the management of the adjacent mobile home park indicates that there are few problems with noise. RECOMMENDATIONS: The Department makes the following recommendations: 1. The Land Use Policy Plan designation for this site be changed to reflect the proposed land Use. 2. The property be rezoned as requested from A-1 to R-5. 3. The portion of the property set aside for commercial purposes to be zoned P-C and that the following be considered as impermissable uses: a. Dwellings b. Gasoline service station C.
