In Re: Proposed Massage Parlor Ordinance
Dear Mayor Goodland and Council Members:
Attached please find a proposed massage parlor ordinance as requested at the
City Council meeting of August 13, 1981. This proposal is largely derived
from the Des Moines ordinance regulating the massage business.
The proposed regulations require both "massage establishments" and "massage
technicians" to obtain licenses before providing "massage services". These
terms are defined in Section 17.24(1) . Licenses expire after one year and
are subject to renewal. Several classes of individuals and institutions are
exempt from the licensing requirements, e.g. , medical doctors, nurses, cosme-
tologists and barbers. Section 17.24(2)(b) . These professions are presently
subject to extensive regulation under state law.
Detailed health standards for licenses are set forth in Sections 17.24(8) and
17.24(5)(c) (vii) . Several practices are expressly forbidden in Section
17.24(9) . Procedures are provided by Sections 17.24(4) and 17.24(6) for the
denial, suspension or revocation of licenses after a hearing before the city
council. Violations of Section 17.24 could be prosecuted as simple mis-
demeanors. See Section 1.7, Ames Municipal Code.
Two provisions have been added to the Des Moines model. Section
17.24(5(c)(v) requires 750 hours of instruction at an accredited school
before a person is eligible for a massage technician license. Section
17.24(9)(g) limits the operating hours of the massage business to 7:00 a.m.
through 10:00 p.m. Both of these regulations have recently been upheld by
the Iowa Supreme Court in MRM, Inc. v City of Davenport, 290 N.W.2d 338 (Iowa
1980) .
