AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF AMES,
IOWA, BY REPEALING SUBSECTIONS 13.20(3), 13.20(5) AND
13.29(5), AND BY ENACTING NEW SUBSECTIONS 13.20(3),
13.20(5), 13.29(5), AND 13.38(1)(n), FOR THE PURPOSE OF
RECONCILING THE STANDARDS FOR THE GRANTING OF
VARIANCES WITH A RECENT CHANGE IN IOWA LAW AND
FOR THE PURPOSE OF CLARIFYING CERTAIN MINIMUM
HOUSING STANDARDS; REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE
EXTENT OF SUCH CONFLICT, IF ANY; AND ESTABLISHING
AN EFFECTIVE DATE.
BE IT ORDAINED, by the City Council for the City of Ames,
Iowa
Section One. The Municipal Code of the City of Ames, Iowa, shall
be and is hereby amended by repealing subsection 13.20(3) and by en-
acting new subsection 13.20(3) to read as follows:
11(3) If it determines that a dwelling unit is in sufficient
conformance with the requirements of this chapter that
there would not be any substantial danger to the health
or safety of occupants and that such an action would be
in the best interest of the public, it may:
(a) Set a reasonable time for partial or complete
abatement.
(b) Permit current occupants to remain for a rea-
sonable time not to exceed the unexpired term
of the current lease, if the owner attests that
the dwelling unit will not be re-rented and
that the current lease will not be extended. "
Section Two. The Municipal Code of the City of Ames, Iowa, shall
be and is hereby amended by repealing subsection 13.20(5) and by en-
acting new subsection 13.20(5) to read as follows:
"(5) The housing appeal board may grant reasonable vari-
ances for existing structures and order the inspector to
issue a letter of compliance if it determines that a mini-
mum housing standard cannot practicably be met and
that the structure is not unsafe for habitation. Before
the appeal board grants a variance to the provisions of
sections 13.33 through 13.35, it shall receive the recom-
mendations of the fire chief. "
Section Three, The Municipal Code of the City of Ames, Iowa,
shall be and is hereby amended by repealing subsection 13.29(5) and
by enacting new subsection 13.29(5) to read as follows:
"(5) Each habitable room or space shall have at least two
electrical outlets where an electrical cord may be easily
and directly plugged in with a minimum of inconvenience.
An overhead light in compliance with subsection 13.31(1)
may be counted as one electrical outlet. "
Section Four. The Municipal Code of the City of Ames, Iowa,
shall be and is hereby amended by repealing subsection 13.38(1)(n) to
read as follows:
"(n) Providing each dwelling or apartment with a refrigerator
and a stove, unless the occupant has agreed in writing
to provide a refrigerator or a stove or both. "
Section Five. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict if any.
Section Six. This ordinance shall be in full force and effect
from and after its passage and publication as required by law.
