Re: Ordinance pertaining to Rental Housing Code
Dear Mayor Goodland and Council Members :
The proposed ordinance was initiated pursuant to Council
Action Form No . 06-02-81. Also, a revision of subsection
13 . 20 has been included to reconcile the rental housing
code with Section 364. 17 (4) , Iowa Code (1981) , which pro-
vides :
"A city which is subject to the uniform housing
code or which adopts another housing code under
this section may provide reasonable variances
for existing structures which cannot practicably
meet the standards in the code but are not unsafe
for habitation. "
Present subsection 13 . 20(3) (b) , Ames Municipal Code, pro-
vides a somewhat different standard for the granting of a
variance. This difference was overlooked during the recent
revision of Chapter 13 . However, since January 1 , 1981, the
rental housing appeal board has been applying the standard
set forth in Section 364. 17 (4) .
