Paul Goodland, Mayor And Members of the City Council Of The City of Ames , Iowa In Re : New State Legislation Effecting City Housing Code Dear Mayor Goodland and Council Members : On May 26 Governor Ray signed H. F. 2536 which becomes effec- tive July 1. Of all the laws passed in the last session affecting cities , this is the one most likely to have imme- diate impact on the activities of the City Council . For this reason I am enclosing a copy herewith for your informa- tion. You will see that what it does is repeal the State Housing Law, Chapter 413 of the Code of Iowa and further require that all cities with a population of 15 , 000 or more must , before January 1, 1981, adopt one of five nationally promulgated housing codes or in the alternative , if the city does nothing, become subject to the Uniform Housing Code promulgated by the International Conference of Building Officials . What this means , of course , is that sometime within the next six months the City Council will need to decide whether to adopt one of these codes or to simply become subject to the code promulgated by the International Conference of Building Officials . Additionally, and perhaps more significantly is the fact that the city is also required to adopt enforcement procedures which shall include a program for regular rental_ inspections , rental inspections upon receipt of complaints and certification of inspected rental housing; and,may additionally ® Combining Education and Industry with Hospitality 03V1333R 30!j A oARi�YTIJ t ! Ilut -2- develop provisions with respect to all or any of the items under new sections 3 (a) through (h) of the Act. Finally, the legislation provides that the city may adopt housing code provisions which are more stringent than those in the model housing code it adopts or to which it becomes subject under the new law. This legislation obviously has the effect of completely re- opening the whole matter of housing code for the City of Ames . Some of you may recall the amount of time and controversy which that entailed some years ago. I have discussed this with Pat Switz of the Community Development Department who has already directed his staff to begin obtaining and re- viewing and five national codes involved. I am also informed that they have plans to attend some seminars that will be conducted by the Office of Planning and Programming in this area. It is not, in my opinion, too soon for the City Council to devise and set in motion some machinery to the orderly development of city policy in this area in response to the new law so that we have things settled well in advance of the January 1 date. Additionally, it has been brought to my attention that in re- codifying and revising the city code, the heating standard in the housing code which was at 65 degrees was reduced to 60 degrees . This is an error that occurred without my intent . I have received complaints that this is a hardship temperature for most people and the fear that at least some landlords will seize upon this as an opportunity to curtail the heat available to their units . To allay these fears it is my sug- gestion that the City Council direct me to prepare immediately, an ordinance which will correct this by re-establishing the heating standard at 65 degrees .
