Dear Sir:
We are a non-profit association that retails natural foods in Ames. One
of our products, empty gelatin capsules, falls under the category of
paraphernalia according to a recently-passed city ordinance. We realize
that we cannot lawfully retail this product after May 20, 1980. We are
also aware, after conversing with the assistant city attorney, that we
do not qualify as an exemption under the existing ordinance.
We would like this City Council to consider us for exemption from this
law and to allow us to sell empty gelatin capsules. We sell to both
members and nonmembers, and many people shoe here because they have
food allergies and health problems that they cannot combat or do not
wish to combat through traditional medical channels. We do not
practice medicine, nor do we promote or advertise the use of herbs
for healing. However, many of our customers are self-taught and well-
read in the area of herbal healing and they buy bulk herbs and bulk
empty gelatin capsules and take them as supplements and cures.
We would like you to add this issue to your next City Council agenda.
We would like to appear at the Council meeting and present written
statements from customers. We feel that we offer a much-needed
and legitimate service to the Ames community and we regret your
decision to make one of our products unlawful.
