REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH, IF ANY,
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, studies have shown certain areas to be unusually sen-
sitive to detrimental effects from development due to unique environmen-
tal circumstances; and
WHEREAS, when studies reveal such environmental circu_nistances
to pertain to an area, additional control procedures and regulations are
deemed necessary to protect the public health, safety and general
v,elfare.
NOW, THEREFORE, be it enacted by the City Council of the City
of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa shall
be and is hereby amended by enacting a new section 38-1050 thereof as
follows:
"Sec. 38-1050. Environmentally Sensitive Area Overlay
a. Purpose. It is the purpose of this section to set out
additional regulations for review and control of develop-
ment and construction in areas found to be and desig-
nated as especially sensitive to adverse public impact
from development due to unique environmental circum-
stances pertaining to the site.
b. Designation of the Area. For purposes of these regula-
tions an area may be designated by resolution of the
City Council, after having received the advice and
comments of the Planning and Zoning Commission, as an
Environmental Sensitivity Overlay Area if the results of
scientific study of the area support the conclusion that
the area so designated is especially sensitive to adverse
public impact from development due to unique environ-
mental circumstances.
C. Studies. The staff of the Department of Community
Development and the Ames Planning and Zoning Commis-
sion are authorized and expected to conduct studies to
evaluate areas in terms of environmental sensitivity as a
part of the continuing process of maintaining a current
comprehensive land use plan for the City. Additionally,
studies done by or for other governmental or private
parties may be adopted for the purpose of this section.

area designated as environr,)ent ,?ly _:r-nsitive no zoning or
building permits shall be iss;. = 1 and no grading, excava-
tion, construction, or change in use shall occur except
in accordance with a plan of development reviewed and
approved by the City Council. The procedures govern-
ing application, review and approval of such plans shall
be the same as those pertaining to the review and ap-
proval of Planned Unit Developments as provided for in
this chapter. As a part of such planning and review
process the developer shall prepare and submit an En-
vironmental Assessment Report which shall set out with
specificity how the problems identified in the study on
which the Environmental Sensitivity Overlay Area desig-
nation is based will be solved, obviated or mitigated in
the public interest. No develepm,ent plan shall be np-
proved until the City Council shall have rcv eived and
approved an Environmental Assessment Report for de-
velopment of the area.
e. Compliance with Plan - Enforcement. Development or
other activities in conflict with the plan, or failure to
implement the plan, including the measures set out in
the Environmental Assessment Report in accordance with
the schedule established in the plan shall constitute a
violation of this section for which any and all enforce-
ment means and remedies established by law for zoning
regulations may be invoked and instituted."
Section Two.- Any and all ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such conflict, if
any.
Section Three. This ordinance shall be in full force and effect
