Re: Flood Plain Management Ordinance AM£S
On February 4, 1980, the Iowa Natural Resources Council approved the
Ames Flood Plain Management Ordinance as required by Section 455A.35,
Code of Iowa, 1979, as amended. Enclosed are Council Order No. 80-1R
approving the ordinance and a certified copy of the approved ordinance.
Please note the conditions under which the ordinance has been approved.
Works on the floodplain in conformity with the approved ordinance will
no longer require Resources Council approval as required by Section
455A.33, Code of Iowa, 1979, as amended, with the exception of such
works as mentioned in condition number three (3) of the Council Order.
Feel free to contact our office at any time for such advice or technical
assistance you may need in administering the flood plain management
regulations or interpreting flood plain data. Thank you for your

BEFORE THE IOWA NATURAL RESOURCES COUNCIL
IN THE MATTER OF THE FLOOD PLAIN
MANAGEMENT ORDINANCE, CITY OF AMES, IOWA ORDER NO. 80-1R
This matter has come on for final consideration by the Iowa Natural
Resources Council at a meeting held on February 4, 1980.
WHEREAS, the Iowa Natural Resources Council, acting under the
authority of Section 455A.35, Code of Iowa, 1979, finds that the pro-
visions of the Ames Flood Plain Management Ordinance (Ordinance #2745)
establishes regulations for the wise use of the floodway and flood
plain; controls future development, fill and obstructions in the floodway
so that the efficiency of the floodway will not be adversely affected or
its capacity unduly restricted; avoids the evacuation of persons residing
in the area of the floodway and the removal of any residential structures
occupied by such persons in the area of the floodway; and provides for
nonconforming uses.
FURTHER, it was found that the flood profiles, floodway limits and
related technical information which are a part of the Ordinance, used
engineering methodology which is consistent with the rules and policies
of the Iowa Natural Resources Council.
BE IT THEREFORE ORDERED by the Iowa Natural Resources Council that
the Ames Flood Plain Management Ordinance which is made a part of this
order be and is hereby approved subject to the following conditions:
(1) no amendments, supplements, changes or modifications to the
approved ordinance shall be undertaken nor variations or
exceptions granted therefrom without prior Iowa Natural
Resources Council approval;
(2) no legal or financial responsibility arising from the adoption
of said ordinance shall attach to the State of Iowa or the
Iowa Natural Resources Council due to issuance of this order;
(3) no structure, dams, obstruction, deposit or excavation that is
not subject to the provisions of the ordinance approved
hereby, shall be erected, used, or maintained in or on any
flood plain except upon specific order of the Iowa Natural
Resources Council approving and permitting same pursuant to
the provisions of Chapter 455A, Code of Iowa, 1979.
BE IT FURTHER ORDERED that the Director of the Iowa Natural Resources
Council be and is hereby authorized and directed to provide and deliver
to the applicant a true and correct exhibit of this determination, duly
certified by him to be a true and correct exhibit of the proceedings of
the Iowa Natural Resources Council in respect to this application at a
meeting of the Iowa Natural Resources Council held on the date hereinabove
indicated.
