WHEREAS, in strict compliance with Chapter 384 of the Code of Iowa, 1979 , as amended , this Council did , pursuant to Resolution of Necessity duly adopted, order the construction of 1978 Street Program No. 2, such improvements having been duly completed, the work accepted and the final assessment schedule as filed by the Engineers having been approved and adopted; and WHEREAS , this Council by resolution did confirm and conditionally levy the deficiencies which appear in the aforementioned final schedule of assessments and certify and order the filing of a listing of said deficiencies with the County Auditor of Story County, and to CitX_Managor , being the City official charged with the responsibility nl� issuing building hermits in the City, all in accordance with and in strict compliance with Section 384 . 63 of the Code of Iowa, 1979 , as amended; and WHEREAS , pursuant to Section 384 . 63 of the Code of Iowa, 1979 , as amended, it is necessary for the Council to establish by ordinance a period of amortization for the 1978 Street Program No. 2; NOW, THEREFORE , Be It ordained by the Council of the City of Ames, in Story County, Iowa, as follows : Section 1. That the useful life of the 1978 Street Program No. 2 is hereby established to be ten ( 10 ) years. Section 2 . That the amortization period of ten (10 ) years shall comme.,ce on the date this Council finally accepted the 1978 Street Prografn No. 2 by resolution passed on the 4th day of December , 1979 . Section 3 . That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, to the extent of such conflict. Section 4 . That if any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. -12- BELIN, HARR.IS.
