In Re: Industrial Zoning Regulations
Dear Mayor Fellinger, Council and Commission Members:
With this you will find a two-page document prepared at
the request of, and as a result of conversations with,
Councilmember Hammer for the purpose of introducing an
industrial zoning concept Mr. Hammer wishes to have con-
sidered at the meeting of January 9 . Under this concept
there would be only two industrial districts:
a. I-1 Industrial - Minimum Planning
b . I-2 Industrial - Intensive Planning
All existing I-1 and I-2 areas would be zoned I-1, and the
existing I-3 zoned I-2 .
The enclosed document sets out regulations proposed for the
"minimum planning" district. The "Intensive Planning" regu-
lations would be the same as proposed by the Commission for
I-3 .
The basis of the two district concept proposed is that some
planning and review is necessary for any industrial use, but
that in areas having a well established industrial character
the planning and review need not be as intensive as in cer-
tain new or particularly sensitive locations . This concept

also recognizes that it is not the type of use per se
that is of public concern, but rather the attributes,
characteristics and consequences of the way in which the
use is conducted that must be known and planned for.

Sec. 38-1023 . "I-1" Industrial District - Minimum Planning
Statement of Intent. It is the intent of this district to
accommodate industrial uses with minimum requirements for
planning.
A) Permitted Uses. A building or premises shall be used
for the following purposes :
Industrial, laboratory, manufacturing, warehousing,
fabricating, institutional, and commercial facilities
excluding shopping centers.
B) Bulk Regulations . The following minimum requirements
shall be observed:
1) Lot Area No minimum requirements
2) Lot Width No minimum requirements
3) Front Yard 10 foot minimum
40 feet if abutting an arterial
street
4) Side Yard 12 feet minimum
40 feet if abutting an arterial
street
5) Rear Yard 12 feet minimum
40 feet if abutting an arterial
street
6) Maximum Height 4 stories or 50 feet
C) Application for zoning permit. The building official and
city planning staff will assist the applicant for a zoning
permit to prepare a written application setting out the
following information :
1) A site plan indicating:
Areas to be developed for buildings, parking, and
landscaping; pedestrian and vehicular circulation;
finished topography; points of ingress and egress;
location of all existing and proposed utilities
(sanitary sewer, water system, storm sewer, gas,
telephone, and electrical power) ; location, size
and characteristics of identification and adver-
tising signs; lighting layout, appurtenances, and
intensity of illumination; elevation of building
and structures.
The objectives of the site plan are :
a) to reduce adverse effects upon the subject pro-
perty and adjacent and nearby property.
b) To control storm water runoff.

c) To control soil erosion.
d) To screen unsightly situations, undesirable
views, and incompatible land uses.
e) To buffer noise and other disturbing sounds .
2) Use Analysis .
A use analysis report shall be prepared which in-
cludes the following:
a) Approximate number of employees.
b) Approximate utility needs and effect upon infra-
structure.
i) Water service
ii) Sanitary sewer service
iii) Electricity
iv) Storm sewer
v) Solid Waste disposal
c) Possible nuisance factors and means for alleviating
those factors.
i) Noise
ii) Odor
iii) Smoke, dust or fumes
iv) Vibration
v) Heat
vi) Other
d) Standard for Decision. No zoning permit will be
issued for any use in the "I-1" District if the
determination is made by the Chief Building
Official that there is reason to believe that
the proposed use as presented by the application
may display or create a negative or nuisance
characteristic such as diminished air quality,
smoke, noise, toxic matter, odor, vibration,
glare, sewage waste, heat or other condition
detrimental to the public health, safety, and
reasonable use, enjoyment and value of other
properties. Furthermore, no zoning permit
shall be issued unless all other applicable
city, state and federal regulations are com-
plied with and all permits required by the
Iowa Department of Environmental Quality are
obtained or applied for.
