In Re: Thirteenth Street Extension - Repeal of Ordinances
And Resolutions Relating to Grade Crossing and
Overpass Crossing Proposals
Dear Mayor Fellinger and Council Members :
On the agenda for the meeting of October 16 is an ordinance
and two resolutions pertaining to some proposals made in
1975 with respect to grade crossings and an overpass for
extension of Thirteenth Street . As you know, we have now
concluded an agreement with the Chicago and Northwestern
Transportation Company for an underpass . We should, there-
fore, repeal the grade ordinance that was enacted on the
basis of a grade crossing, repeal the resolution which de-
clared a policy of exercising eminent domain to acquire an
easement for a grade crossing, and adopt a resolution to
clarify that the proceedings of the Council meeting of
August 5 , 1975 which set the date of September 9 , 1975 as
a date of hearing on a proposal to require construction of
an overpass , and the meeting of August 19 , 1975 when said
ordinance was voted on for passage on one occasion, be
repealed.
Concurrent with this action, the Chicago and Northwestern
will be dismissing its suit to enjoin the construction of
Thirteenth Street and its suit to appeal from the city' s
condemnation of right-of-way for grade crossing on Thirteenth
Street and the Railroad' s application for interlocutory
appeal to the Iowa Supreme Court, all as is set out and
explained in a copy of a letter to counsel for the railroad
that is enclosed herewith for your information. It is my

hope that the Council will enact these measures as soon as
possible.
