City Attorney January 5 , 1979 Honorable Lee Fellinger, Mayor And Members of the City Council Of the City of Ames, Iowa In Re: Ordinance to Repeal Chapter 22 Pertaining to Milk and Milk Products Dear Mayor Fellinger and Council Members : This chapter of the municipal code is totally obsolete and in conflict with the laws of the State of Iowa . In my report to the City Council on needed ordinance revi- sions under date of October 13, 1978 , I recommended that this chapter be repealed. The inspection and regu- lation of milk and milk products has been effectively pre-empted by the State of Iowa and is now a function of the Department of Agriculture. Under the provisions of section 192 . 30 of the Code of Iowa 1977 , the City may conduct inspections of milk and milk products only in accordance with an agreement between the City and the Department of Agriculture. In talking with Dr. Shoeman I have been informed that the City of Ames believes that the milk inspection procedures and policies of the Department of Agriculture are entirely adequate for the needs of the City of Ames. Sampling and inspection of frozen desserts and milk products served in restaurants will continue as part of the restaurant inspec- tions being conducted under agreement with the Department of Agriculture by the City ' s sanitarian.
