HomeMy WebLinkAbout~Master - Adopting State Building Code r ORDINANCE NO. 2696 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA BY REPEALING SECTIONS 8-1001 THROUGH 8-1017, SECTIONS 13-1001 THROUGH 13-1022 AND SECTIONS 21-1/2-1001 THROUGH 21-1/2-1006 ; AND ENACTING NEW SECTIONS 8-1001 and 13-1001; FOR THE PURPOSE OF ACCEPTING AND ADOPTING THE STATE BUILDING CODE OF THE STATE OF IOWA AS THE BUILDING CODE FOR THE CITY OF AMES , IOWA; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH TO THE EXTENT OF SUCH CONFLICT IF ANY; PROVIDING A PENALTY AND ESTABLISHING AN EFFECTIVE DATE WHEREAS , it is found and declared by the Iowa General Assembly in Section 103A. 2 of the Code of Iowa, 1977 that " . . . the building codes that do exist in the govern- mental subdivisions of this state, as enacted and applied, are not uniform and impede the utilization of new and im- proved technology, techniques, methods and materials in the manufacture and construction of buildings and structures . " ; and, WHEREAS , Chapter 103A of the Code of Iowa 1977 authorizes and directs the promulgation of a "state building code" ; and, WHEREAS , said "state building code" has been established and promulgated as part of the Iowa Administra- tive Code pursuant to the procedures for administrative rule making provided for by Chapter 17A of the Code of Iowa 1977; and, WHEREAS , section 103A. 10 as well as the aforesaid administrative rules authorize and empower a governmental subdivision of the State of Iowa to adopt and accept the application of the state building code as the local building code; and.. WHEREAS, it is deemed to be in the best interest of the City of Ames that the aforesaid "state building code" be adopted as the local building code for the City of Ames, Iowa. NOW THEREFORE, BE IT ENACTED: Section One . The Municipal Code of the City of Ames, Iowa shall be and is hereby amended by repealing sections 8-1001 through and including 8-1017 , sections 13-1001 through and including 13-1022 and sections 21-1/2-1001 through and including 21-1/2-1006 as said sections have existed heretofore. r � -2- Section Two . The Municipal Code of the City of Ames, Iowa shall be and is hereby further amended by enacting new sections 8-1001 and 13-1001 , said new sections to read as follows : "Sec . 8-1001 . The ' State Building Code ' of the State of Iowa as promulgated and set out in rules 630-5 . 1 (103A) through and including 630-5 . 899 (103A) Iowa Administrative Code is adopted and accepted as a local building code for the City of Ames, Iowa. Violation of the standards and provisions of said state building code or failure to comply with the requirements of said code for permits , inspections and fees shall be an offense against the City of Ames , Iowa when occurring within the City of Ames . Sec. 13-1001 . Electrical Rules and Regulations of the State Building Code Adopted The ' State Building Code ' of the State of Iowa has been adopted and accepted as the local building code for the City of Ames, Iowa. The electrical rules and regulations forming a part of the state building code and promulgated as rules 630-5 . 200 (103A) through and including 630-5 . 299 (103A) Iowa Administrative Code shall govern electrical work and installations in the City of Ames . Violation of the standards of said rules or failure to comply with the provi- sions of said rules for permits, inspections , fees shall , when occurring within the City of Ames, constitute an offense against the City of Ames, Iowa. " Section Three . All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section Four. Violations of the provisions of this ordinance shall constitute a simple misdemeanor punishable by a fine not to exceed one hundred ( $100) dollars or by impri- sonment for a period not to exceed thirty (30) days . Section Five . This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this 16th day of Januar 19 79 Mary E.
