City Attorney August 30, 1978 Honorable Lee Fellinger, Mayor And Members of the City Council Of The City of Ames , Iowa In Re : Amendment to the Municipal Penal Code Dear Mayor Fellinger and Council Members : In March, on my instigation, the City Council responded to the new state penal code by repealing a number of provisions in the Municipal code and enacting one section which listed the provisions of the state penal code which constitute simple misdemeanors and declare them to be offenses against the City of Ames when committed in the City of Ames . In doing this, one simple misdemeanor was omitted, that of: "Interference with Official Acts" The elements of this offense are essentially the same as harassment of public officers and employees which is included in the municipal code as Section 24-1001 (g) , but the "inter- ference with official acts" offense speaks specifically to peace officers and may be somewhat broader in scope. Therefore, I have proposed the enclosed ordinance and request that it be enacted by the City Council for the purpose of adding the offense of "Interference with Official Acts" to those lists of crimes known under the laws of the state of Iowa which can be prosecuted by the City Attorney ' s office as a violation of a city ordinance.
