HomeMy WebLinkAbout~Master - Establishing Procedures for Mayoral Appointments ORDINANCE NO. 2638 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA BY RE- PEALING SECTION 2-2013 OF THE MUNICIPAL CODE AND ENACTING A NEW SECTION 2-2013 FOR THE PURPOSE OF ESTABLISHING CERTAIN PROCEDURES AND DUTIES RELA- TIVE TO THE MAYOR IN APPOINTING PERSONS TO ADMINISTRATIVE AGENCIES AND IN MAKING APPOINTMENTS TO THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF AMES REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT, IF ANY; AND, ESTABLISHING AN EFFECTIVE DATE BE IT ENACTED by the City Council of the City of Ames , Iowa: Section 1. The Municipal Code of the City of Ames, Iowa shall be and is hereby amended by repealing section 2-2013 thereof as said section has existed heretofore and enacting a new section 2-2013 to read as follows : "Sec. 2-2013 Appointments to Administrative Agencies; Whenever a power of appointment relative to an admin- istrative agency and in making appointments to the Zoning Board of Adjustment of the City of Ames has been conferred by ordinance on the Mayor, such power of appointment shall be exercised only in accordance with and subject to the following: (a) During the first week in January of each year the Mayor shall notify, in writing, all members of the City Council and all newspapers , radio and television stations in the City of Ames of such positions as described above as will be open for appointment effective on or before April 1, and of any other such appointments that can be then anticipated for any other time during the coming calendar year, and of procedures and means by which persons may apply to the Mayor for appointment to such positions. (b) A minimum of two weeks prior to placing such an appointment on the council agenda for confirma- tion , the Mayor shall submit to the council , in writing, a list of all those persons who have applied to the Mayor for appointment to the position to be filled, and of all names that have been submitted to the Mayor for such posi- tion by others, including the names submitted by members of the City Council . (c) The Mayor shall indicate on the above described list the person or persons most preferred by the Mayor for appointment to the position , stating reasons for the choice. If no one has applied for the position and no names have been submitted by others the Mayor shall so report. (d) The members of the Council may, after receiving the Mayor' s list as described, respond individ- ually to the Mayor, either in writina or orally, with regard to any concerns they may have about the person or persons the Mayor prefers for appointment. (e) The Mayor will state the name of the appointee to the position, in writing, in the agenda materials delivered to the Council prior to the meeting at which council approval will be sought. (f) No appointment shall be deemed approved by the Council except by resolution receiving an affirma- tive vote of a majority of the whole number of the council , that is , four affirmative votes. As used in this section, "administrative agency" means a body as defined in section 362.2(23) of the Code of Iowa, established in accordance with Chapter 392 Code of Iowa. " Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict if any. Section 3. This ordinance shall be in full force and effect from and after its passage and publication as required by law. PASSED this 21 day of February , 1978. Mary E.
