RE: The request to consider rezoning
from C-2 to C-4 certain properties
bounded by Duff Avenue, Lincoln Way,
Clark Avenue, and the Chicago and
Northwestern railroad tracks.
Honorable Mayor and Members of City Council:
The Planning and Zoning Commission during its regular meeting of May 18, 1977,
considered City Council's request to look into the feasibility of rezoning the
above described area and voted 7-0 to approve the following motion:
To accept the recommendation of the staff and initiate this request
to the City Council; also to recommend deletion of the footnote (1)
from the C-4 district in the chart in Section 38-1033.
A copy of the Department's report and a map delineating the affected properties
are attached.
The deletion of footnote (1) helps to alleviate a problem which affects a large
number of properties which are zoned C-4. The footnote states that all parcels
of land must meet the requirements of the R-4 district in figuring the minimum
parcel width. This then renders all parcels with widths less than 50 feet as
nonconforming. Any request for a building permit for construction, reconstruc-
tion, remodeling, and so forth for such properties would be denied due to their
nonconformity and appeal to the Zoning Board of Adjustment must be made. This
has occurred in the past. This situation has been considered not desireable.
