City Attorney May 27 , 1977 Honorable Lee Fellinger , Mayor and Members of the City Council For the City of Ames , Iowa In Re : Ordinance to Regulate Parking On Apple Avenue And A Portion of Peach Lane in the Old Orchard Mobile Home Park Dear Mayor Fellinger and Council Members : About two years ago , the City of Ames accepted a deed to what is called Apple Avenue and a portion of Peach Lane in the 0ld Orchard Mobile Home Park . These areas are not con- sidered city streets but are classified as public places . The reason for taking a deed to these areas was to provide access to the extreme southern tip of South Riverside Drive after a railroad crossing was closed in exchange for the opening of a new railroad crossing at the point where South 16th Street crosses South Riverside Drive . Recently the City Manager and I have been advised by the management of the Old Orchard Mobile Home Park that they have been experiencing difficulty in enforcing the parking rules , which all tenants of the park agreed to , on Apple Avenue and that portion of Peach Lane that was deeded to the city. The management of the park contends that the people who they experienced this trouble with maintain that since it is a public place the mobile home park has no legal right to regulate their parking. The management of the mobile home park would like the city to enforce parking regulations on Apple Avenue and that portion of Peach Lane that has been deeded to the city as a public place . The parking regulations that they desire to have enforced are set out in a proposed ordinance which I have prepared and included herewith . Respectfully submitted, John R .
