RE: Don W. and Margaret V. Stewart
Rezoning of Property Located on
the South Side of Ken Maril Road,
from South Duff Avenue one-half
mile east, from A-1 to R-1
Honorable Mayor and Members of City Council:
The Planning and Zoning Commission during its regular meeting of March 11,
1977, considered the above request for rezoning and by a unanimous vote of
5-0 (with Riis and Lex absent) , approved the following motion:
To table this request to the April 8 meeting and that the questions
on the special assessment being voided be forwarded to City Council.
The staff did recommend to the Commission that this matter be tabled to en-
able an expanded study of the area in terms of future utility needs and ar-
rangements, appropriate land uses, and potential impact by the airport.
The meeting did produce miscellaneous questions which the Commission in-
structed be forwarded to members of Council. Some of the questions, al-
though not verbatim, were as follows:
Why was the 200-foot area south of Ken Maril Road brought into the
City on December 31, 1976? Why wasn't the new corporate limit es-
tablished in the road which would have preempted any possibility of
assessment against this property?
Why did City Council during consideration of the Teagarden area sani-
tary sewer assessment project, vote to impose an assessment upon this
land?
Is it in the community's best interest to compel the landholder,
through levy of assessment with dubious benefits, to request re-
zoning and dispose of his property for urban development?
This is prime agricultural land that ought to be saved?

Perhaps City Council should consider voiding this assessment?
Please find attached a copy of the Department's report on this rezoning
request.
