Recently, in the processing of the proposed plat of The Union Addition,
it has been discovered there is an error on the Zoning Map. Simply, the
error is the placement of the district line separating R-1 and R-2 via the
extension of the centerline of Phoenix Street to Garfield Avenue. The
error is the result of transcribing the official zoning map-the one in
booklet form-to the map we use and sell to the public.
The biggest effect of the error is on the Council-approved preliminary
plat of Sunset Rock. Sunset Rock was processed on the basis that the row
of lots north of Phoenix was in the R-2 district and the lots were sized
for R-2 lot areas.
It is hereby being requested that Council initiate the rezoning changing
the lots and a sliver of land in The Union Addition from R-1 to R-2.
This then places the zoning district line to coincide with the centerline
of Phoenix Street. The legal description is as follows:
Beginning at the intersection of the Easterly line of Ontario
Heights llth Addition, and the centerline of Phoenix Street;
Thence continuing along the centerline of Phoenix Street
extended 72.32 feet. , to the point of beginning of a 145.93
foot radius curve concave to the SIV; Thence Southeasterly
along said curve 113.35 feet to a point of tangency; Thence
South 440 21' East, 72.85 feet to the point of beginning of
a 144.85 foot radius curve, concave to the NE; Thence South-
easterly along Said curve, 113.77 feet, to a point of tangency;
Thence South 89 21' East, 5.0 feet, to the Viest line of
Sunset Rock Addition as proposed; Thence continuing South
89 21' East, 343.37 feet to the point of beginning of a 75.0
foot radius curve, concave to the MV; Thence Northeasterly
along said curve, 105.84 feet to a point of tangency; Thence
North 90 48' East, 77.79 feet, to the point on intersection
with southerly end of Garfield Avenue as it now exists, said
point being approximately 170 feet North of the SW of Lot 9,
of the subdivision of the Nest 634.75 feet of NE Fractional
Quarter and part of E Half - IM Quarter of Section 5-83-24;
Thence Westerly to the point of beginning.
