RE: Petition for Rezoning of Property
Located at 924 Garfield from R-1
to R-2 by Ray and Helen Bryan.
Honorable Mayor and Members of City Council:
The Planning and Zoning Commission during its regular meeting of June 11, 1976,
considered the above petition for rezoning for the second time. This request
was initially considered by the Planning and Zoning Commission on May 14, 1976,
and was tabled because neither the property owner nor a representative was able
to attend the meeting to support their request.
During the recent meeting the Commission unanimously approved the following
motion:
That this request be denied.
This case presents itself as an unusual one. It has brought to the attention of
the Department and the Commission a possible problem relating to nonconforming
uses, which may be more widespread than what might be believed. The petitioner
emphasized that he would be unable to reconstruct his nonconforming duplex in the
R-1 zone in the event that it would be more than 60% destroyed since his insurance
policy indicates that he may not make claim for damages until such duplex be re-
constructed. The obvious problem here is that the duplex could not be reconstructed
in an R-1 zone, and that the only relief available to the petitioner, aside from
getting rezoning, would be for him to make an appeal to the Zoning Board of Adjust-
ment for a variance after he had suffered the consequence of loss of property.
