Be it ordained by the City Council of `— the City of Ames, Iowa. 4 Section 1. That all able bodied male residents o fthe City of Ames, between the ages of twenty one and forty five Years, except those exempt by statute, shall, between the first day of January and the first day of November of each Year, either by themselves or satisfactory - substitutes, perform two days labor of eight hours each upon the streets, aven- ues, alleys, highways or public grounds within the city, under the supervision of the Street Commissioner and at such times and places as he may direct. Section 2. The Street Commissioner shall give to each individual, who is re- under the provisions of this or- dinance to perform labor, a notice in writing three days prior to the date, upon which the labor is to be performed, stat- ing the time when and the place where such party is to report for said work. Section 3. Any person, who is requir- ed by the terms of this ordinance to perform labor, may pay, in lieu thereof, the sum Of two and one half dollars, providing such sum is paid on.or before the time he is notified to report for said f work. In case the said last mentioned ! sum is not id on or before said time and he does not report at said time and perform the labor herein required, then such person shall pay in lieu of saidlabor the i hall be u f duefromthe date three ofhis failure 1 � ~lc 't to so report. l t 1 Section 4. For each days failure to ry attend and perform the labor at the time and place specified, or to pay the said sums of money in lieu thereof as ' vided in section three horeof, unless ex- �+ cused by the street commissioner, the delinquent shall forfeit and pay the sum Of two dollars, not exceeding four dol- ��` tars in all. Section 5. An be again notified to excused shalt , perform such labor _ - pre pay the said sums in lieu thereof. All persons claiming to be exerhpt from 71 labor under this ordinance, shalt within S three days after receiving notice to per- t form such labor, furnish the Street Com- missioner with an affidavit showing the nature and extent of the disabilities en- • titling him,to such he Pails to do so, he exemption. In case of failure to per form said labor as herein provided or G f - •` to pay the said sums in lieu thereof, to- ^•..� 1 Igether with the forfeit within ten days from the expiration of the time fixed for the performance of said labor, an action to recover the said sum of three dollars and the penalty herein provided, shall be ,•/ commenced by the said street commis- f r stoner, in the name of the City of Ames, before the Mayor of said City, or before any Justice of the Peace of said City,]and the same prosecuted to judgment. And the City Solicitor, shall upon notice i i appear and prosecute said action. - Section 7. No roperty be exempt on an execcution "ss red eonsany judgment or costs obtained under this ordinance. ?i Section S. The taxes and forfeit mon- ey so collected, shall be expended upon "^1 the streets, avenues, highways, alleys and public grounds of said City. All such f .l �' r r tax and forfeit money remaining unpaid on the first day of November in each year _ J may be certified to the County Auditor' at any time before the following first day of December, and shall be entered by 1 him upon the tax list of said County and ; treated and collected as ordinary county ! taxes, and shall be a lien upon all real property of the delinquent. Section 9. All ordinances or parts of 3 1 ordinances in conflict herewith are here- n by repealed. Section 10.
